Legal Expert Weighs in on Rivers State Assembly Crisis.

Femi Falana, a human rights lawyer, has expressed support for a Rivers High Court decision to suspend 25 members of the Rivers State House of Assembly who defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

The court has restrained the affected members, who are loyal to Minister Nyesom Wike, from parading themselves as lawmakers until a hearing on May 29.

Falana stated in an interview with ChannelsTV that the assembly members have lost their seats due to their defection.

“In the case of Adetunde and the Labour Party, the Supreme Court made it clear that you cannot decamp and then remain a member of a legislative house in Nigeria unless you can show that there is a division in your party. Today, the PDP is one”.

Meanwhile, a fresh crisis has erupted in the Rivers State Assembly, with some lawmakers electing Victor Oko-Jumbo as speaker. Oko-Jumbo, who represents the Bonny constituency, was elected by lawmakers loyal to Governor Fubara. However, the number of lawmakers who supported his election is unclear.

Falana emphasized that the lawmakers need a quorum to elect a speaker, citing the Constitution. He also noted that removing the governor through impeachment requires a two-thirds majority of the legislature.
