    BREAKING: Court Sacks Akwa Ibom Senator Over Defection, Orders Fresh Election In 14 Days 

    Court has sacked Akwa Ibom senator for defecting from PDP to YPP.

     

    The Federal High Court in Abuja has sacked the senator representing Akwa Ibom North East district, Albert Akpan, over his defection, last year, from the Peoples Democratic Party (PDP).

     

     

    The court declared his seat vacant and ordered the Independent National Electoral Commission (INEC) to conduct a bye-election to fill it within 14 days, counting from 20 January when the judgement was delivered.

     

     

    Although Mr Akpan was recently convicted and jailed for corruption, his sacking by the court has nothing to do with that.

     

     

    His sacking by the court is based on his defection from the PDP to the Young Progressives Party (YPP).

    The convict, who is on post-conviction bail, is the Akwa Ibom State governorship candidate of his new party, the YPP, in the forthcoming March 2023 governorship election.

     

    Delivering judgement in the political suit filed against him by the PDP, the judge, Fadima Aminu, ruled that he was not qualified to retain the seat after resigning from the party which sponsored his election to the Senate for a four-year tenure in 2019.

     

    The judge ordered Mr Akpan to stop parading himself as a senator and ordered him to pay N5 million in costs to PDP which sued him over his defection to the YPP.

     

    Ms Aminu said Mr Akpan, a two-term senator, failed in his obligation to prove that his defection from PDP was necessitated by serious rancour and steep differences in the ranks of the party.

     

    Without a justifiable reason, the judge said, the defection violated section 68(1)(g) of the Nigerian constitution and implied that he must vacate his seat.

     

     

    “Therefore, this honourable court holds that the 1st defendant (Mr Akpan) who resigned from the plaintiff (PDP) but failed in his duty before this honourable court to prove the alleged serious rancour and steep differences in the ranks of the plaintiff (PDP) which made him to resign or defect to Young Progressives Party (YPP), the 1st defendant is in violation of section 68(1)(g) of the 1999 Constitution by refusing to vacate his seat as a senator in the senate won under the sponsorship of the plaintiff,” the judge said.

    Mr Akpan defected from the PDP in July 2022 citing unresolved grievances from the party’s governorship primary election in Akwa Ibom State.

     

    He announced the YPP as his new party in his letter notifying the Senate President of his defection from the PDP.

     

    He was among federal lawmakers who switched parties in the aftermath of last year’s primary elections across parties.

     

    Following the development, the PDP sued Mr Akpan on 28 July 2022, urging the court to declare his seat vacant by virtue of the provisions of sections 68(1), and 62(b) of the Nigerian constitution affirmed by a plethora of Supreme Court decisions.

     

    The party joined the Senate President and INEC as defendants.

     

    The PDP argued that there was no division in its fold to warrant Mr Akpan’s defection to another party.

     

     

    It presented in court among other exhibits, Mr Akpan’s letter of resignation from the party. The letter dated 15 July 2022 was sent to the chairman of the PDP in his Ibiono Ibom Eastern Ward I in Ibiono Local Government Area of Akwa Ibom State, Ariekamauwen Asuquo.

     

    PDP said Mr Akpan ought to have voluntarily relinquished his seat in the Senate after defecting to another party, but chose to continue to take benefit of his election into the Senate on its platform.

     

    But Mr Akpan argued that the PDP lacked the right to file the suit as it was not listed among the authorities with powers to enforce section 68(1) of the constitution to declare his seat vacant.

     

    He said by virtue of the provision of the constitution, only the President of the Senate, with regard to a senator, or the Speaker of the House of Representatives, for a member of the lower house, could validly enforce the constitutional provision.

     

    But the judge held that the argument was “misconceived”, adding that “there is nothing in the provision of section 68(2) of the constitution that expressly provides that it is only the persons stated in the referenced section that can give effect to the provision of section.”

     

     

    The judge, who backed her reasoning with judicial precedents, also dismissed the arguments and claims put forward in the senator’s defence by the Senate President, Ahmad Lawan.

     

    An affidavit deposed on behalf of Mr Lawan had said he had yet to receive formal communication from Mr Akpan about his defection. The claim is contradicted by the wide reportage given to the Senate President’s reading of the senator’s defection letter on the floor of the Senate on 20 July 2022.

     

    Contradicting itself, the affidavit said Mr Lawan had read reports, which he believed to be true, about the divisions in the PDP in Akwa Ibom State.

     

    The judge held that the self-contradiction in the Senate President’s affidavit had destroyed all the facts stated in it.

     

    “Therefore, the statement of the 2nd defendant is self-contradictory as the 2nd defendant claims on one hand that there has been no formal communication to him of the defection of the 1st defendant from the plaintiff and yet, on the other hand, agrees that the 1st defendant notified him of his defection and resignation from the plaintiff and being also aware of the division and factionalisation of the plaintiff in Akwa Ibom State as the reason for the 1st defendant’s defection.

     

     

     

    “This honourable court agrees with the submission of the learned counsel for the plaintiff that once an affidavit is self-contradictory, it needs not be challenged by the other party as whatever facts the affidavit intends to establish would have been destroyed by the contradiction,” Ms Aminu ruled.

     

    The judge said Mr Akpan’s resignation letter dated 18 July 2022 which he also publicised via his Twitter handle with other information about his defection “stands in the defence of the case of the plaintiff (PDP).”

     

    The court, therefore, held that the PDP successfully proved its case “on the preponderance of evidence”

     

    Meanwhile, Mr Akpan has since appealed to the Court of Appeal in Abuja to avert the implementation of the judgement, with fresh elections to usher in a new set of senators a few weeks away.

     

    The judgement came about a month before the general election to fill all 109 seats in the Senate.

     

    The four-year tenure of the current senators elected in 2019 expires in early June, approximately four months away.

     

    But PDP’s lawyers from the law firm of Tayo Oyetibo, a Senior Advocate of Nigeria, have written to the INEC chairman to “immediately take steps to timeously comply with the court’s order.”

     

    A copy of the letter seen by PREMIUM TIMES and its authenticity confirmed to one of our reporters in a phone call to one of the signatories, Olaniran Obele, is dated 24 January and bears INEC’s acknowledgement stamp dated 25 January.

     

    The Supreme Court has ruled on different occasions that a division within the ranks of a political party must be so deep that the party can no longer function at the national level for it to be an acceptable excuse for the defection of a state or federal lawmaker.

     

    But despite the judicial precedents, lawmakers still defect without justification. The presiding officers of the legislative houses empowered to declare the seats of such lawmakers are always lethargic to make such pronouncements, regardless of the party affiliations of the defectors.

     

     

    PDP took benefit of such defection when, in 2018, then Senate President, Bukola Saraki, and some other senators joined its fold upon their dumping the ruling All Progressives Congress (APC).

    Court sacks Senator Bassey Akpan, orders refund of salaries

    Senator Bassey Akpan was removed from the Senate as the senator representing the Uyo Senatorial District by an Abuja-based Federal High Court after he joined the Young Progressives Party, or YPP.

    In the decision on Friday, the presiding judge, Justice Fadima Murtala Aminu, declared Senator Akpan’s seat vacant and commanded INEC to hold a bye election to fill the position.

    The Judge further decreed that the Senator must return to the National Assembly all funds and benefits received after July 2022, the date on which he defected peacefully from the PDP to the YPP.

    Having resigned his membership in the PDP prior to the expiration of the term for which he was elected to represent the people of the Akwa Ibom North-East Senatorial District, Justice Aminu determined in a lawsuit with the file number FHC/ABJ/CS/1249/2022 that Senator Akpan, who was sponsored to the office of a Senator by the PDP, is no longer qualified to retain his seat in the Senate.

    According to section 65(2)[B] of the Federal Republic of Nigeria’s 1999 constitution, Justice Aminu declared Senator Akpan’s seat vacant.

    The 3-man election tribunal chaired by Justice Tertsea Kume on Friday in Osogbo, the state capital, ruled that Oyetola is the duly elected governor of the state and ordered the Independent National Electoral Commission to issue Certificate of Return to Oyetola while declaring the result that produced Ademola Adeleke as Governor as null and void.

    In a congratulatory message to Oyetola, Tinubu said the victory of Oyetola was deserving, describing it a “triumph of courage and perseverance, and light over the forces of darkness that sought to arrest the progressive good governance the APC administration delivered to the people of Osun State under the leadership of Oyetola.”

    Tinubu said in the statement signed by his Media Aide, Mr. Tunde Rahman: “I heartily rejoice with Alhaji Adegboyega Oyetola on his much deserved victory at the Election Tribunal today. It is the victory of light over darkness. A triumph of perseverance, courage and justice over electoral fraud and democratic perversion.

    “The forces of darkness plotted to extinguish the able leadership and progressive good governance that improved the quality of life of our people under your leadership. But today, the Tribunal delivered justice and restored the mandate freely given to you and our great party.

    Fresh Twist Emerges Over Bola Tinubu Eligibility As Court Gives Crucial Order

    Bola Tinubu, the APC presidential candidate’s eligibility to run as the legitimate party presidential candidate in next month’s elections has once again been established.

    The application requesting that Tinubu be removed from the list of candidates registered to run in next month’s presidential elections was rejected by the federal high court in Abuja on Friday, January 25.

    The judge who presided over the lawsuit FHC/ABJ/CS/1960/2022 seeking to disqualify Tinubu from running for president opined that the applicant lacked locus standi (legal right to bring the action).

    Justice Nyako claims that because the litigant is not a legitimate APC member, they are not authorized to bring such a lawsuit against Tinubu.

    In her decision, Justice Nyako also mentioned that the plaintiff had filed a related lawsuit that the court had previously dismissed for lack of merit.

    The plaintiff was also charged with abusing the legal system by engaging in numerous legal actions, according to the court. According to Justice Nyako, there was no justification for considering such actions against Bola Tinubu, the APC flag bearer, so the litigant lacked the legal standing to bring the lawsuit.

    In the meantime, Tinubu will go into the elections next month as one of the top favorites to win the presidency. However, Peter Obi of the Labour Party, who is well-liked by young people, and Atiku Abubakar of the Peoples Democratic Party (PDP), whose strength is in northern Nigeria, will present tough competition for Tinubu.

    The All Progressive Congress (APC) and Bola Tinubu are engaged in conflict for various reasons.

    Prior to the presidential elections next month, the APC and the Peoples Democratic Party (PDP) have engaged in a heated verbal battle. Most recently, the PDP brought a lawsuit to have Bola Tinubu removed from the running for president of the APC.

    CBN has replied Bola Tinubu over campaign rally comment on hoarding of New naira notes.

     

    The Central Bank of Nigeria (CBN) has stated that the policy of the redesigned new naira notes was not targeted at any politician or political parties but in the interest of the nation.

     

    Presidential candidate of the All Progressives Congress (APC) Bola Tinubu had on Wednesday during his campaign rally in Abeokuta, Ogun alleged that the new naira notes policy was an act of sabotage against his ambition.

    The Director of Finance in CBN, Benjamin Fakunle who spoke during the apex bank’s sensitisation event and old notes swap in Ilawe-Ekiti, Ekiti South West local government area of Ekiti state, explained that the January 31 deadline for the old notes would not be extended, adding that the policy was not to scuttle the 2023 general election.

    He explained that the policy of the new naira notes for N200, N500 and N1,000 was conceptualised to control the amount of money in circulation and as well address the increasing kidnapping for ransom in the country.

    Fakunle who advised the people to embrace the policy by exchanging their old naira notes with the new notes in commercial banks, noted that the cashless policy of the CBN would in no small measure improve the economy of the country.

     

    He said, “Let me put it on record that we are not targeting anybody. The last time that Nigeria redesigned notes was more than nine years ago and this is something that we normally do in a period of between five and seven years; so, nobody is being targeted.

     

    “You will see that by the time these new notes are in circulation and we go cashless, you will find out that the incidents of kidnapping and other crimes will come to an end because there will be no monies to pay for ransom. Beyond that, we would be sure that the amount of money that is in circulation is within the vault of the CBN.

    “The policy is not target at anybody. We are just doing our work the way it is, within the mandate of the law and within the constitution of the Federal Republic of Nigeria.”

    On the allegations of hoarding and non-availability of the new notes in banks in the state, the Director of Finance explained that banks have been instructed not dispense old notes in their Automated Teller Machines, saying officials of the apex bank were monitoring to punish defaulting banks.

    “There is no bank as at today in the whole of Ekiti State that is dispensing old currency notes. I have been monitoring, I have gone round most of the banks and there is no bank that is dispensing old notes.

    ”We have given banks the instruction that they should not pay old currency notes from their ATMs. Any bank that does that now, once we have evidence, we will penalise the bank. We have mandated all banks and we have given all banks enough redesigned notes to put into their ATMs. That is the current situation and we are not looking at any extension of the deadline slated for January 31.

    “Tuesday next week is the last day for the old notes. Part of the efforts to be sure that date is sacrosanct is why we are here in Ilawe-Ekiti. We are even going to the hinterlands where people are unbanked and we are facing the masses.

    “This policy is for the masses, we want the masses to get the redesigned notes as and when they require. Everybody that is literate is supposed to be able to do transfer for any services rendered to him or her. In actual sense of it, our actual target is to go cashless in Nigeria and that is our mandate and we will make sure that is done,” he said.

    The Central Bank of Nigeria (CBN) is under more pressure to postpone the January 31 deadline for the phase-out of the old N1,000, N500, and N200 notes. The new notes are nowhere to be found, according to relevant stakeholders, who also claim that the deadline is impossible.

    The Northern Elders Forum (NEF), the Muslim Rights Concern (MURIC),  Governor Abdullahi Umar Ganduje of Kano State, and others have added their voices in support of delaying or completely scrapping the policy ntil the nation is ready.

    They made the decision with only three days left before the deadline of January 31 as citizens all over the nation complained of extreme hardship due to their inability to use the redesigned naira notes from the banking hall or the ATMs (ATMs).

    The  Peoples Democratic Party, PDP has suspended the Ebonyi State chairman of the party, Mr. Okorie Okoroafor, because of alleged anti-party activities.

    This was stated in a statement released by the PDP’s national publicity secretary on Friday in Abuja.

    After an urgent meeting on Friday in Abuja, according to Ologunagba, the PDP National Working Committee (NWC) approved the suspension.

    “The National Working Committee (NWC) on behalf of the National Executive Committee (NEC) approved the suspension of Okoroafor with effect from Friday, January 27, in accordance with sections 29 (2) (b) and 57(3) of the PDP Constitution (as amended).

    Governor of Osun, Senator Ademola Adeleke, has rejected the Friday morning tribunal ruling that fired him.

    Ejes Gist News has earlier reported that the Election Petition Tribunal, presided over by Justice Tertse Kume, sacked Adeleke as governor of Osun for cases of overvoting.

    In a statement released by his spokesperson Mallam Olawale Rasheed, Adeleke referred to the tribunal’s ruling as ” a miscarriage of justice” and vowed to appeal the decision to the Court of Appeal.

    The Independent National Electoral Commission’s (INEC) chairman, Professor Mahmood Yakubu, has acknowledged that foreign hackers are attacking the commission’s database.

    The 2023 General Elections; Judiciary and Sustainability of Nigeria’s Democracy was the theme of Yakubu’s speech on January 26 at the 2022 National Conference of the National Association of Judiciary Correspondents (NAJUC) in Abuja.

    The attacks are not just coming from Nigeria, according to the INEC chairman, who was represented by the deputy director of ICT, Dr. Lawrence Bayode.

    BREAKING: Tribunal sacks Osun Governor Adeleke, See details

    The Tribunal Nullified Election Of Senator Ademola Adeleke As Osun Governor and Declared Oyetola as Winner.

    The Election Petition Tribunal chaired by Justice Tertse Kume has sacked Osun Governor  Senator Ademola Adeleke.

     

    The majority judgement of two judges against one ordered that the Certificate of Return should be withdrawn from Adeleke and issued to Adegboyega Oyetola.

    The tribunal sacked Adeleke for overvoting in some polling units across the State.

    The panel led by Justice Terste Kume also ordered that Gboyega Oyetola of the All Progressives Congress (APC) be issued a certificate of return.

    The Osun State Governorship Election Petition Tribunal has declared Gboyega Oyetola the winner of the election, nullifying the election of Governor Ademola Adeleke.

    The tribunal on Friday in Osogbo nullified the election result declared by the electoral commission (INEC) on 16 June 2022, which gave Peoples Democratic Party candidate Adeleke the victory (PDP).

    The court ordered INEC to revoke the certificates of return issued to Mr. Adeleke and his deputy, Kola Adewusi, who had both been sworn in.

    The panel led by Justice Terste Kume ruled that Mr. Oyetola of the All Progressives Congress should receive the certificate of return (APC).

    Justice Kume ruled that the governorship election was not conducted in accordance with the Electoral Act of Nigeria.

    The court determined that the election for governor was marked by overvoting. It stated that after deducting the excessive votes, Mr. Oyetola received 314, 921 votes at the election.

    Therefore, the court ordered that Mr. Oyetola be reinstated as governor of Osun State.

    Mr Adeleke was declared the victor after receiving a total of 403,377 votes. He won in 17 of the state’s 30 Local Government Areas (LGAs).

     

    Mr. Oyetola of the APC won with 375,040 votes in the remaining 13 LGAs.

    Fifteen candidates competed for the governorship, but the race was particularly close between Mr. Adeleke and Mr.

    In his petition, the former governor of the state, Mr. Oyetola, claimed that in 749 polling places, the election was marked by over-voting.

    In addition, he claimed that Mr Adeleke submitted forged academic credentials to the Independent National Electoral Commission (INEC) to run for office.

    Mr. Adeleke is anticipated to appeal the tribunal’s decision, and he will remain in office pending the outcome of the appeal by higher courts.

    The tribunal convened in August 2022, a few weeks after the election for governor.

    Mr. Oyetola and the APC are the petitioners in this case, and their lead counsels are Lateef Fagbemi and Akin Olujimi.

    INEC is the first defendant, Mr. Adeleke is the second, and PDP is the third.

    Paul Ananaba represents INEC, Alex Iziyon represents the PDP, and Onyechi Ikpeazu represents Mr. Adeleke. All the attorneys are seasoned professionals.

    BVAS: INEC to conduct mock accreditation of voters in 436 PUs

    The Independent National Electoral Commission (INEC) announced on Friday that it was prepared to conduct a mock accreditation of voters before the Presidential and National Assembly elections on February 25.

    Prof. Mahmood Yakubu, National Chairman of the Commission, disclosed this information during a meeting with Resident Electoral Commissioners from the 36 States of the Federation and the FCT.

    The mock accreditation exercise, which will take place in approximately 436 polling places across the country, is intended to test the readiness of the Biomodified Voter Accreditation System, according to the official (BVAS).

    According to him, the distribution of sensitive election materials to the various states is well underway, while the distribution of non-sensitive materials has been completed.

    As of Thursday, approximately 839,720 of the 940,200 PVCs sent to Lagos state had been collected. He expressed satisfaction with the Nigerians’ desire to collect their voter cards.

    He stated that the commission was committed to ensuring that all Nigerians collect their PVCs prior to the general elections and that, if necessary, the commission would consider other options for PVC collection.

    “NGX views sustainability as not only an important but also a profitable frontier of its business, and it is currently developing a framework for carbon credit trading certifications, pending regulatory approval.

    “On the digital transformation of the capital market, the Exchange is collaborating with telcos and banks to launch USSD; unlocking the African capital markets through payment integration with Afreximbank’s Pan African Payment Settlement System.”

    He added that the Exchange has also set its sights on the creation of new products designed to appeal to Nigeria’s lower socioeconomic strata.

    “NGX is also committed to increasing youth participation through the development of digital asset products powered by blockchain technology, non-depositary receipts, and the overall expansion of the market’s liquidity pool.

    “Overall, 2023 is likely to be a new dawn for the Nigerian market and economy as significant macroeconomic and political events take shape,” Popoola said.

    The Cross River State Inter-Party Advisory Council (IPAC) has accused INEC and security for allegedly trying to cover up the accusations made by Agba Jalingo.

     

    The statement reads:

    “Recall that on Saturday, 21st January, 2023, a social media report emanating from Citizen Agba Jalingo, Publisher of CrossRiverWatch alleged that Bi-Modal Voters Accreditation System, BVAS meant for Cross River State elections were diverted to Cross River Governor’s lodge.

     

     

    “In order to interrogate the process to enable us to unravel the truth, the leadership of Inter Party Advisory Council, IPAC, met with the Resident Electoral Commissioner, Pastor Prof. Gabriel O. Yomere on Monday, 23rd January, 2023, in the company of some Heads of Department. After a detailed discussion, the REC assured us that he was going to lead political parties, Commissioner of Police and Director DSS to inspect the BVAS by 2pm the next day.

    “Contrary to our agreement with the REC, political parties were not allowed to even see alone inspecting the BVAS. We were only informed in a press conference organized by the REC that INEC and security agencies have inspected the BVAS and went ahead to claim that all the BVAS are intact.

     

     

    “Enraged by the unprecedented disappointment, political parties led by the IPAC Chairman stormed out of the meeting and decided to hold a Press Conference with the following resolutions;

     

    1. That IPAC, Cross River State maintains reservation about the report from Citizen Agba Jalingo and calls for a more thorough investigation from INEC National Headquarters, Abuja. This is because the purported change in our agreement with the REC without prior information can be extrapolated to mean that the allegation by the reporter can not be wished away.

    2. IPAC further insist on inspecting the BVAS and in addition request to be allowed to take full record of the serial number or barcode of the 3,281 BVAS sent to the state for purposes of thorough scrutiny of the BVAS to forestall the importation of fake BVAS.

    3. IPAC passes a vote of no confidence and demands the immediate redeployment of Commissioner of Police, CP Sule Balarabe, and DCP Operations, Frank Ibu, with immediate effect. The recent crises of confidence with the leadership of the Cross River State Police Command started two weeks ago when the CP invited political parties to an interactive session in far away Ogoja only to postpone the meeting without any prior notice and explanation to political parties despite mobilizing our members for the meeting. Where the Inspector General refuses to effect the redeployment, we may be left with no option than ask the INEC National Chairman to postpone elections in Cross River State as no political party will be available to sign Peace Accord since we can not guarantee the security of Cross Riverians in the forthcoming election.

    Finally, we will like to warn that political parties in Cross River State have resolved to ensure a free, fair, credible and peaceful election in 2023 and will not condone any compromise from anybody, no matter how highly placed.

    On the strength of the foregoing, we call on all citizens to wake up and be vigilant as it appears clearly that there’s a grand plan to compromise the 2023 general election in Cross River State.

    Former Cross River Governor, Donald Duke has slammed Governor Ben Ayade over text message to him.

     

     

    “He is not a relative or family but I see him as an acquaintance who amuses me when I am bored. If I’m bored I could sit with Ayade and drink small stout and he will make me laugh but to think that I am his mate, I am not his mate at all.

    “When we started this journey about 24 years ago, he was somewhere acquiring his fake degrees. Fake! You can’t stand here and say this is a professor and Ayade would affirm that he is a professor. Professor of what? You know, we admit something, we made a mistake. In 2015, we made a grievous mistake by bringing someone from nowhere to Government House, Calabar and we have paid dearly for it. We are regressed for over thirty years. It’s worse than I met it in 99 and he has the temerity to send me a text telling me such nonsense.

     

    “You know, when you’re a governor, you’re the Chief Security Officer in the State. When ENDSARS struck, he was the first one to run. Even his ADC, did not know where he was. He is the most cowardly person that has occupied Government House. Absolutely! Now he says why is he the object of those campaign? Why not?

    “We are going to campaign on your records. It’s a good thing and a blessing to us that he left PDP and went to where he is because you know they say, water finds its level, he has found his level; level of non-entities, that’s where he is. It’s not my place to derogate anybody, but I find that for that man who has ridiculed our State to this level with a twist and stupid budgets, you don’t raise more than a hundred billion, you say you’re budgeting 1.3 trillion. Are you crazy? Then you give it all kinds of fanciful names then you now have the temerity to talk to me because we are playing politics. What insolence!
