    Breaking: Court Rules on suit seeking to sack Buhari, stop 2023 elections

    A Federal High Court sitting  in Abuja has dismissed a suit filed by Ambrose Owuru, the presidential candidate of the Hope Democratic Party (HDP) in the 2019 election, seeking to remove President Muhammadu Buhari from office and halt the 2023 general elections.

    Owuru, in the suit instituted against Buhari and the Independent National Electoral Commission (INEC) had asked the court to declare him the winner of the 2019 presidential election after the seat of the presidential was declared vacant.

    The HDP candidate also said the court to determine the constitutionality of the shift in 2019 presidential election from Feb. 16 to March 23, 2019 by INEC.

     

    Owuru claimed in the lawsuit that INEC violated the constitution by shifting the presidential election in an illegal and unlawful manner, and that the declaration of Buhari as the winner of the illegal act should be declared null and void.

    He asked the court to declare him the poll’s victor.

    In addition, he stated that the petition he filed against Buhari had not been decided by the Supreme Court as mandated by law.

    The politician asserted that his Supreme Court petition was improperly dismissed due to his absence at the apex court due to discrepancies in the hearing dates communicated to him.

    He claimed that Buhari had usurped his term in office.

    He therefore pleaded with the court to remove Buhari, declare him (Owuru) the legitimate President, and compel Buhari to return all salaries, emoluments, and security votes he had received.

    The HDP candidate for president also asked the court to order his inauguration for a four-year term upon Buhari’s removal from office and to prevent INEC from conducting the 2023 election.

    In his ruling, Justice Inyang Ekwo dismissed the lawsuit on three major grounds.

    Justice Ekwo ruled that the lawsuit was an abuse of court process, time-barred, and an affront to the Nigerian Supreme Court’s authority.

    The judge also ruled that the entire lawsuit was groundless, frivolous, annoying, and vexatious.

    Petrol Shortage Sparks Protests In Edo, South-South Nigeria. 

    On Monday, hundreds of protesters blocked roads in Benin City, the capital of Edo State in South-South Nigeria, in response to the prolonged fuel shortage and price increase.

     

    A video of the protest that emerged online on Monday morning shows fires on the road with thick smoke billowing from the burning materials.

    A voiceover in the video stated, “This is occurring live in Benin City, the capital of Edo State, where a massive protest is occurring due to the fuel crisis. There are demonstrators blocking roads and setting fire to the roadblocks.”

    Earlier, Ejes Gist News reported that the price of premium motor spirit (PMS), also known as gasoline, had increased, with some gas stations charging as much as N500 per litre in Effurun, Delta State.

    Recent reports accuse the government of quietly increasing the price of the product from N165 per litre to N185 per litre. Previously, the official price was N165 per litre. Due to the product’s scarcity and rising demand, however, many gas stations have been charging between N400 and N500 per litre.

    Omobude Agho, former coordinator general of the Edo State Civil Society Organisation (EDOCSO), stated on behalf of the protesters that the increase in fuel prices and scarcity of the products have exacerbated the plight of state residents.

    The protest will continue in the state until the price of fuel becomes affordable and the product is made available to the masses, according to Agho, who asserted that the country’s citizens have been taken for granted and forced to endure hardships despite the country’s abundance.

    “Fuel is now N700 per gallon, and the minimum wage is N30,000. “A bag of rice costs more than N50,000 while the minimum wage remains at N30,000,” he said.

    “You cannot move from one location to another unless you are carrying a heavy budget, and the minimum wage has not changed. We believe we cannot continue like this in this country, and we are urging Nigerians to take action.”

    Henceforth, he stated, the state’s civil society organisations will engage those who are sabotaging the national economy and causing hardships for the populace.

    “We will fight all economic saboteurs, in high and low places. Previously, we stated that we would resist them, but now we will fight them. Wherever you encounter black marketers, pursue them without pity for their poverty. “Everyone who is wicked, regardless of wealth, is wicked,” said Agho.

    “Wherever we capture a black marketer, we will seize the fuel, convert it, and if you have no use for the fuel, dispose of it. Therefore, when those on the black market lack fuel, petrol stations will be required to sell at a fixed price.

    According to Mr. Timipre Sylvia, Minister of State for Petroleum Resources, the committee will be chaired by the President in his capacity as Minister of Petroleum Resources, while he will serve as the alternate chairman.

     

    The committee’s mission is to address the issues plaguing the downstream sector of the petroleum industry, which have led to a gasoline shortage in Nigeria.

     

    It will also monitor petroleum products, particularly petrol, to determine daily national consumption and eliminate smuggling.

    A former Director of the Independent National Electoral Commission (INEC) has claimed that not all data was transmitted when the All Progressives Congress (APC) obtained the Bimodal Voter Accreditation System (BVAS) server report following the judgment of the Osun State Governorship Election Petitions Tribunal, which removed Governor Ademola Adeleke and reinstated Gboyega Oyetola.

    Oluwole Osaze-Uzzi, a former INEC director of voter education and publicity, there shouldn’t have been a discrepancy in the governorship election for Osun State in 2022.

    Diezani Alison-Madueke Moves To Recover Seized Assets, Applies To Court

    Former Minister of Petroleum Resources Diezani Alison-Madueke has taken steps to get her seized property back.

    She requested that an order issued to the Economic and Financial Crimes Commission (EFCC) for the final forfeiture of her seized assets be overturned by the Federal High Court of Abuja.

    In an originating motion, Alison-Madueke requested an order extending the deadline for requesting permission to ask the court to set aside the EFCC’s public notice of its intention to conduct a public sale on her property.

    The anti-corruption agency had planned to hold a public auction of all assets seized from Alison-Madueke starting on January 9 as stated in its public notice following a number of court decisions and orders issued in the commission’s favor as final forfeiture orders against the former minister’s property and personal effects.

    However, the former minister asked the court for five orders in a motion dated January 6 and filed before Justice Inyang Ekwo with the file number FHC/ABJ/CS/21/2023.

    The EFCC is the only respondent in the case, despite the fact that Alison-Madueke is the applicant.

    The former minister claimed that there was no legal basis for the various orders, and he claimed that they “ought to be set aside ex debito justitiae.”

    She claimed that throughout the entire process leading up to the orders, she was not given a fair hearing.

    “The numerous court orders issued in the respondent’s favor and upon which the respondent issued the public notice to conduct public sale of the items contained in the public notice, most of which court the interest of the applicant, were issued in violation of the applicant’s right to a fair hearing as guaranteed by Section 36 (1) of the 1999 Constitution, as amended, and other similar constitutional provisions,” she claimed.

    She claimed that she was never served with the charge sheet, proof of evidence, or any other summons related to the criminal charges that were brought against her and were being heard by the court.

    She also claimed that by withholding or failing to disclose crucial information, the courts were misled into issuing several of the final forfeiture orders against her assets.

    “The various applications upon which the courts rendered the final forfeiture order against the applicant were obtained upon gross misstatements, misrepresentations, non-disclosure, concealment, and suppression of material facts. This honorable court has the authority to set-aside same ex debito justitiae, as a void order is as good as if it had never been made in the first place.

    The orders were made without considering the applicant’s constitutional rights to a fair trial and to his or her property.

    She cited, among other reasons, the fact that “the applicant was never served with the processes of court in all the proceedings that led to the order of final forfeiture.”

    But the EFCC urged the court to reject Alison-application Madueke’s in a counter affidavit that was sworn to by Rufai Zaki, a detective with the commission.

    The investigation into a case of official corruption, criminal conspiracy, and money laundering against the former minister and some other parties involved, according to Zaki, who was a member of the team, has made it abundantly clear that she was involved in some criminal activity.

    According to him, Alison-Madueke was subsequently charged in court under charge number FHC/ABJ/CR/208/2018.

    We herein rely on the charge FHC/ABJ/CR/208/2018 dated November 14, 2018, which was submitted to this Honorable Court and is also attached as Exhibit C in the applicant’s affidavit, he said.

    Most of the depositions, according to the EFCC agent who claimed to have seen the ex-motion, minister’s were false.

    In the affidavit in support, he claimed that, in contrast to her deposition, the majority of the cases that resulted in the final forfeiture of the disputed property “were action in rem, same were heard at various times, and determined by this honourable court.”

    Before making final decisions, the commission was mandated by the courts, according to him, to publish an invitation in the newspaper asking parties to provide justification as to why the property in question should not be forfeited to the federal government.

    In response to one of the forfeiture applications, Zaki claimed that Nnamdi Awa Kalu spoke on behalf of the former minister.

    He stated, “We humbly rely on the decision of Hon. Justice I.L.N. Oweibo dated September 10, 2019, which is shown in Exhibit C of the applicant’s affidavit.

    Contrary to what the officer claimed, the court had already ordered the final forfeiture of the assets at issue in the current application since 2017 and this decision had not been overturned or reversed on appeal.

    He claims that the properties have been sold in accordance with the law.

    Oluchi Uche, Alison-attorney, Madueke’s explained to Justice Ekwo on Monday that they had just received service from the EFFC on Friday and needed some time to respond to the counter affidavit.

    Farouk Abdullah, who was represented by the anti-graft agency, did not object, so the judge continued the case for a hearing until May 8.

    Buhari appears to be showing lackadaisical attitudes toward the presidential ambition of Bola Tinubu.

    A few weeks before the 2023 presidential election, the camps of the presidential candidate of the All Progressives Congress (APC), Bola Tinubu, worried about the lackadaisical attitudes of Muhammadu Buhari’s presidency.

    Buhari, his Vice, Professor Yemi Osinbajo, and other members of his cabinet appear to be showing lackadaisical attitudes toward the presidential ambition of the former Lagos State Governor, Daily Post reports.

    Since he started his campaign a few months ago, the presidency has not shown a serious level of commitment toward ensuring the victory of Tinubu and the APC. While Buhari has attended very few campaign rallies, Osinbajo has totally abstained.

    Many are yet to understand why those at the Aso Rock Villa, including some leaders of the APC, are not really interested in whether Tinubu wins or not. In fact, there are rumours that some governors are surreptitiously hobnobbing with the opposition ahead of the general election.

    As the Jagaban could no longer pretend about the unfavourable development, he was compelled to let the cat out of the bag during his recent visit to Abeokuta, the Ogun State capital, exposing the level of infighting tearing the party apart underneath.

    Tinubu had tackled the Buhari-led government over the new naira notes redesign and the lingering fuel scarcity, alleging that some individuals were sabotaging his presidential ambition through the two developments.

    According to Tinubu, they were deliberately hoarding petrol and naira notes, a situation he speculated was to affect his chances negatively.

    “With our PVC, we will wrest power from them. Even if they said there is no fuel, we will trek. They are full of hanky panky. They are cleverly creating fuel scarcity. Let the fuel continue to be scarce, they know where they hoard it.

    “You hoard the naira, you hoard fuel, but we will vote and we will win. You can even change the ink on the naira notes, we will win. They sabotage fuel supply. Whether they supply fuel or not, we will go and vote. This is a superior revolution. You know me. We are going to win,” Tinubu said in Yoruba.

    After making the statement, the media space was awash with comments from the opposition, who saw Tinubu’s words as an attack on President Buhari and his party, the APC.

    The moment he realised the statement could breed chaos within the party, Tinubu and his campaign team immediately embarked on damage control, saying the presidential candidate was actually attacking the opposition Peoples Democratic Party (PDP), and not the APC-led Federal Government.

    But, many are seeking to know if the PDP is in charge of the Ministry of Petroleum or President Buhari. They also want to know if the Central Bank of Nigeria is under the control of the PDP or the Federal Government. The answer to this is clear enough to know who Tinubu was referring to during his campaign in Abeokuta.

    The question on the lips of some Nigerians is, why is the presidency less concerned about Tinubu’s presidential race?

    Buhari’s anointed candidate

    Before the APC primary, there were indications that President Buhari had an anointing candidate among those eyeing the presidential ticket. Apart from Osinbajo, a sizable number of Buhari’s kitchen cabinet members, his allies and others, were in the race for the ticket.

    Before the primary, Buhari had met with governors of the party, telling them to allow him choose his successor the same way they choose theirs.

    Buhari told the governors: “In keeping with the established internal policies of the party and as we approach the convention in a few days, I wish to solicit the reciprocity and support of the Governors and other stakeholders in picking my successor, who would fly the flag of our party for election into the office of the President of the Federal Republic of Nigeria in 2023.

    “We gave governors re-election tickets or an opportunity to pick their successors; allow me to pick my successor.”

    Though Buhari did not name his choice, but as Tinubu realised that he was not likely to be the anointed candidate of Buhari, he began to talk tough.

    In the buildup to the June 2022 APC presidential primary, Tinubu was in Abeokuta to seek the support of party delegates. At the Presidential Lodge in Ibara Housing Estate, where he met party leaders, Tinubu went back memory lane to recount how he helped Buhari to power after the former Army General had cried on live television.

    He also said he was the one who nominated Osinbajo to be Buhari’s running mate after Bukola Saraki kicked against the Muslim-Muslim ticket.

    Osinbajo, at that time, was also contesting the APC ticket with Tinubu, the main reason he was being described as a “betrayer” in the Tinubu camp.

    “He tried the first time and failed. He tried a second time and failed. He tried a third time and failed. He even cried on television that he will never run for president again. I went to meet him and told him this is not a crying matter: ‘we will support you and you will be president’. If not for me, he wouldn’t have become the president,” Tinubu said in Yoruba.

    His comment was said to have angered the President and his appointees, who replied Tinubu, telling him not to claim he was the one who single-handedly made Buhari president.

    A statement by a presidential media aide, Garba Shehu, partly read: “There are those who advised the president to run again; those who decided to build a political party – the APC – that could finally be the political vehicle capable of delivering victory where all other opposition parties and alliances before it had failed.

    “Those decisions may have been agreed upon by a few. But they were delivered by thousands and voted for by tens of millions. No one can or should claim to have made this possible.”

    It was believed that Tinubu’s angry comment in Abeokuta in June helped him in getting the APC ticket, as it caused the president to steer clear of whatever happened at the APC convention.

    However, it is left to be seen if the latest Abeokuta comment from Tinubu would also earn him a positive action from the presidency.

    The Nigerian Central Bank (CBN) has announced a 10-day extension for the use of old naira notes throughout the country,  Ejes Gist News reports.

    The CBN governor told journalists on Sunday morning that he had President Muhammadu Buhari’s approval for the extension.

    He stated that the new deadline is now February 10 as opposed to January 31.

    Mr. Emefiele spoke in Daura, Katsina State, following a meeting with the president, who was performing official duties in his home state.

    Mr. Emefiele stated that Nigerians who have not yet exchanged their old naira notes for new ones now have the opportunity to do so.

    He stated that the opportunity must be taken advantage of because the deadline will not be extended again.

    The CBN introduced redesigned 200, 500, and 1,000 naira notes in October and set a deadline of January 31 for the use of the old notes.

    However, new currency has been scarce, prompting calls for an extension.

    Mr. Emefiele did not elaborate on what the central bank was doing to address the lack of new currency notes.

    Statistics indicate that more than 85 percent of the currency in circulation is stored outside of commercial bank vaults, which the central bank announced in October of last year.

    Mr. Emefiele asserted on Sunday that the currency has produced significant results.

    “According to the bank’s available data, the amount of currency in circulation in 2015 was only N1.4 trillion. “As of October 2022, the amount of currency in circulation had risen to N3.23 trillion, of which only N500 billion was in the banking industry and N2.7 trillion was held in people’s homes,” he stated.

    “Political sabotage also exists in addition to economic hardship. Never before have we been as intentionally divided politically along racial, religious, and other fault lines. Government appointments are biased and uneven because of mediocrity, nepotism, and a disregard for competence and merit. The upcoming elections could make the situation worse.

    “Political parties and politicians are now more willing to abandon some of the measures put in place to foster a sense of community among all groups. Exclusion is accepted as commonplace. We are faced with disunity, and many of our leaders are more focused on their own self-interests than the continued existence and well-being of our country.

    “Let me reiterate that the concerns expressed regarding the type of choices we have, such as in the Presidential elections, are valid and should not be dismissed.

    “Nigeria belongs to us all, and no region of the nation should be in any way uncertain about its place in this union based on ethnicity, religion, language, region, culture, or social standing.”

    The beauty of democracy, according to Obasanjo, is that it cannot be imposed on Nigerians, he said.

    Northern Leaders Optimistic Kwankwaso Will Step Down For Atiku Before February 25th Presidential Election 

    Northern leaders are optimistic that Kwankwaso will step down for Atiku Abubakar before the February 25th presidential election, Ejesgist News reports.

     

     

    Northern leaders on Sunday said they were optimistic that Senator Rabiu Kwankwanso, the presidential candi­date of the New Nigeria Peoples Party (NNPP), will eventually step down for Atiku Abubakar, the flagbearer of the Peoples Democratic Party (PDP).

    Though Kwankwaso, who has a large followership known as ‘Kwankasiyya movement’ in the Northern part of the country, has acknowledged pressure from certain quarters to step down, he has vowed not to withdraw from the race but slug it out with other contestants in the February 25 presidential election.

     

    Late last year, in Lagos, when asked if he will step down in the days ahead, he said, “We are not merging with any political par­ty, and anybody thinking I am stepping down must be mis­chievous. We have our names already approved by INEC to contest. NNPP is all out to win the 2023 general elections. No se­rious person should now think of anyone of us stepping down at this stage. I am ready for all candidates for debates.”

     

     

    Also speaking at Chatham House few days ago, the former Kano State governor said he re­plied those asking him to step down that he may consider the option if he sees any candidate better than him in terms of ex­perience.

    “What I told them is what I will tell you. If anybody wants Kwankwaso to withdraw, just bring criteria and select the best. Anytime I have a better candidate, I am ready to talk to him,” he said.

     

    However, a leading member of the Northern Elders Forum (NEF), who spoke with Daily Independent on Sunday, said the leaders are optimistic that a partnership will be brokered be­tween Kwankwaso and Atiku.

     

    According to him, the North­ern leaders have agreed that there is a need for the region to forge a common front ahead of the election, especially given the hostility and gang-up against Atiku by the PDP G-5, led by Governor Nyesom Wike of Riv­ers State.

     

    The NEF chieftain, who asked not to be named as he is not authorised to speak on the issue, said eminent retired generals, religious leaders and traditional rulers are all talking with Kwankwaso on the need to collapse his structures for Atiku.

     

    He added that if the North can present a consensus can­didate and the Southern votes are shared between Asiwaju Bola Tinubu of the ruling All Progressives Congress (APC) and Peter Obi of the Labour Party (LP), Atiku will easily coast home to victory.

     

    “Yes, I can confirm that talks are ongoing. Kwankwaso keeps insisting that he will not step down but we are optimistic that he will listen to the voice of reason especially from our elder statesmen and royal fathers from the North.

     

    “From what we have seen so far, the best we can do in the North is to present consensus candidate. With the popularity of Kwanwaso and Atiku in the North, we believe the presiden­tial election will be a done deal because Atiku already com­mands appreciable followership in the South. Kwankwaso’s sup­porters are also in the South too.

     

    “If we can unite in the North by fielding a sole presidential candidate, then the election is as good as won because the Southern presidential candi­dates will divide the Southern votes. Atiku will also get votes in the South”.

     

    Speaking with our correspondent, the Atiku Abubakar Presidential Campaign Coun­cil said Atiku has promised to run a government of national unity and will partner patriotic Nigerians in the mission to re­build the country from the ruins caused by the APC.

     

    Kola Ologbondiyan, a spokes­person of the campaign council, said “Alhaji Atiku Abubakar has told Nigerians that he will run a government of national unity and that he will operate an open policy. He said if elected, every Nigerian will be carried along.

     

    “So, we have no doubt that many Nigerians are going to work with Atiku in rescuing our nation from the bad governance of APC. He is ready to partner with any of the presidential candidates, including Senator Kwankwaso, in the task of re­building Nigeria”.

    “So our door is open to any­one who wants to join us in this task of restoring Nigeria’s unity through equity, social jus­tice, mutual collaboration, and consensus among our diverse peoples”

    Tinubu accuses Atiku and the PDP of cloning the Vanguard and Daily Trust websites to spread false information.

    Asiwaju Bola Tinubu, the presidential candidate of the ruling All Progressives Congress APC, has accused Alhaji Atiku Abubakar, the presidential candidate of the opposition Peoples Democratic Party PDP, and his party of cloning the websites of two newspapers to spread fake news in Hausa against his own candidature.

    Sunday, Tinubu made the allegation in a statement released by Mr. Bayo Onanuga, Director of Media and Publicity for the APC Presidential Campaign Council PCC.

    “We want to warn Nigerians about the sinister moves and carefully orchestrated plans of the opposition Peoples Democratic Party to unleash a wave of fake news, particularly in the Hausa language, to malign, defame, and delegitimize Asiwaju Bola Ahmed Tinubu and the All Progressives Congress in the eyes of Nigerians.

    “This smear campaign by the PDP has been perfected by a team working day and night at the PDP’s national headquarters in Wadata House, Abuja,” he said.

    He stated that the PDP and its social media operatives have already begun disseminating fake news to dupe gullible Nigerians by spoofing and using parody social media accounts of prominent newspapers and blogs.

    “Numerous parody social media accounts, such as ‘Vanguard Hausa’ and ‘DailyTrust Hausa,’ have been created and are being used to spread false information on Facebook, Twitter, Instagram, WhatsApp, and other digital platforms.

    “We discovered on Facebook that Daily Trust Hausa was founded as K.R.K Media on August 9, 2021. It changed its name to Daily Trust Media on 7 December 2022 and uses the fictitious domain name daily.com for its website.

    “On 13 August 2022, a second Daily Trust Hausa Facebook account named Facos News Hausa was created with the intention of publishing posts about Musicians. On December 29, 2022, just 22 days after its other clone, it changed its name.

    “Vanguard Hausa was developed on December 21, 2021. Its website was unable to load.

    “These are all parodies The PDP used Facebook accounts on Saturday to spread malicious rumours that Tinubu’s trucks carrying old Naira notes were arrested in Lagos.

    “To clarify, Daily Trust does publish a Hausa newspaper called Aminiya, which also has the same name on Facebook. We are unaware that Vanguard has a publication with a similar format.

    Tinubu stated, “We urge the two newspapers, Daily Trust and Vanguard, to inform Facebook and Meta that they have been cloned by fake news merchants for PDP’s political offensives.”

    According to him, the PDP has also recruited numerous social media actors to execute its smear campaign on its behalf.

    The only way for the PDP and its failing presidential campaign to have a shot at winning the February 25 presidential election, according to him, is to manipulate Nigerians and Northerners to view him (Tinubu) in a negative light.

    “At this juncture, we deem it necessary to alert Nigerians to this evil plot’s potential to cause discord, animosity, and unwarranted crisis, with attendant security implications for the nation.

    “Part of the PDP’s evil plots will be to make false claims and allegations against President Muhammadu Buhari, Asiwaju Tinubu, his running mate, Senator Kashim Shettima, and other APC National, Regional, Zonal, and State leaders using manipulated videos, doctored voice-overs, photoshop images, and other means, all in an attempt to win the election by any means necessary.

    “The PDP and its candidate for president, Alhaji Atiku Abubakar, are aware that they cannot win the upcoming election. They are also aware that Nigerians will never vote for the PDP to take over the leadership of Nigeria after 16 years of misery.

    “Among the many legacies the party left behind were insecurity, a poorly managed economy, a looted treasury, and a decrepit national infrastructure consisting of roads, power, ports, rail, and pipelines. The Buhari administration is still attempting to undo the massive damage the party caused to our country.

    “Because Atiku’s presidential campaign is on the verge of collapsing, the PDP hopes in vain to avert the impending electoral loss by sponsoring a coordinated smear campaign against the APC, our presidential candidate, and even the government.

    “We use this platform to urge Nigerians, and in particular our fellow countrymen in Northern Nigeria, not to be deceived.

    According to audio and video leaks by Atiku’s former Media Aide, Mike Achimugu, “Atiku and the PDP have nothing positive to offer Nigerians other than his ravenous ambition to enrich himself, his family, and his cronies.”
