Setback for Kwankwaso As Fresh Court Document Vindicates INEC Over Removal Of Kano NDC Governorship Candidate
Fresh court documents have provided further clarification on the decision of the Independent National Electoral Commission (INEC) to withhold the name of the Nigeria Democratic Congress (NDC) governorship candidate in Kano State, Comrade Aminu Abdussalam Gwarzo, from its updated list of candidates for the 2027 governorship election.
The certified true copies of the documents from the Federal High Court in Kano indicate that INEC was acting in compliance with an interim court order restraining it from publishing or making changes to the NDC’s governorship candidate list pending the determination of a suit challenging the party’s nomination process.
The case, marked Suit No. FHC/KN/CS/440/2026, was instituted by three aggrieved NDC members, Garba Umar Isa, Yau Nasiru and Atiku Jamilu Abubakar, against INEC and the NDC.
The plaintiffs reportedly approached the court over the emergence of the party’s governorship candidate, alleging dissatisfaction with the process through which the Kwankwasiyya Movement leader, Rabiu Musa Kwankwaso, allegedly endorsed Aminu Abdussalam Gwarzo as governorship candidate and his son, Mustapha Kwankwaso, as running mate.
The aggrieved members subsequently sought judicial intervention over the development.
What the Federal High Court Ordered
According to the court documents, the applicants approached the Federal High Court through an ex parte motion filed on October 17, 2026, seeking interim protective orders.
In a ruling delivered on October 27, 2026, by Federal High Court 3 in Kano, the court restrained INEC, its agents, officers and representatives from publishing the name of any candidate on the NDC’s governorship list for the 2027 Kano election pending the hearing of the substantive motion.
The court also restrained the electoral commission from tampering with, altering, adding to or removing any name from its final governorship candidate list published on or about October 10, 2026, pending further proceedings.
The judge further directed that the court order and accompanying processes be served on the defendants before the next adjourned date.
An accelerated hearing was also ordered, with the matter initially scheduled for November 2, 2026.
Why the Court Documents Matter
The emergence of the certified court documents is significant amid political disagreements and criticisms surrounding INEC’s failure to include Gwarzo’s name in its updated list of governorship candidates.
The documents provide evidence that the electoral commission was operating under a judicial directive restricting it from publishing or altering the NDC’s governorship list while the dispute over the party’s nomination process remained before the court.
This development could strengthen INEC’s position against allegations that it independently removed or withheld the candidate’s name without legal justification.
However, the court’s interim order does not amount to a final determination of the dispute or establish which faction or individual has the legitimate right to the party’s governorship ticket.
Case Adjourned To November 16
Meanwhile, the case could not proceed as scheduled on November 2 after counsel to Comrade Aminu Abdussalam Gwarzo approached the court with an application seeking to be joined in the suit.
Following the development, the court adjourned the matter to November 16, 2026.
The next hearing is expected to provide another opportunity for the parties to present their positions as the legal battle over the NDC’s governorship nomination in Kano continues.
Until the substantive issues are determined, the party’s candidate list remains subject to the court’s directives, leaving the political future of the NDC’s 2027 Kano governorship ticket unresolved.
