    In a significant legal admission, Nigeria’s attorneys have acknowledged the country’s involvement in a contentious $60 million dispute, which originated from the harassment and deportation of Chinese investors in Ogun State. The lawyers’ admission contradicts recent public statements made by both the Tinubu administration and former Ogun State Governor Ibikunle Amosun, who had denied any wrongdoing in the matter.

     

    The dispute centers around the Ogun-Guangdong Free Trade Zone, a multibillion-naira project in Igbesa, Ogun State, managed by Chinese firm Zhongshan. Court documents reveal that the Nigerian police and immigration officials, acting under federal directives, harassed and expelled Chinese expatriates attempting to reclaim control of the zone.

    These actions were carried out at the behest of Amosun, who, during his tenure as governor, arbitrarily ousted the investors from the facility.

     

    The revelations emerged as Nigeria battles to prevent asset seizures in the United States, following a ruling by the U.S. Court of Appeals for the District of Columbia. The court upheld a previous judgment that found Nigeria and Ogun State liable for breach of contract and abuses against the Chinese investors, awarding them $60 million in compensation.

     

    The legal battle has plunged Nigeria into a diplomatic quagmire, with the Chinese investors reportedly detaining Nigerian aircraft in France as part of their enforcement strategy. Despite denials from Amosun and the federal government, evidence presented in court—including text messages—suggests that Nigerian officials threatened Zhongshan’s executives, further complicating the case.

     

    Nigeria’s legal team, led by Squire Patton Boggs LLP, argued that the involvement of Ogun State in the contract disputes should not strip the country of its sovereign immunity under the Foreign Sovereign Immunities Act. However, the U.S. appellate court ruled that the New York Convention, governing international trade and arbitration, applied to the case, thus allowing the Chinese investors to continue their legal pursuit of Nigeria’s assets.

     

    The case has sparked confusion and concern within Nigeria, with reports indicating that the Tinubu administration may consider further legal action, potentially appealing to the U.S. Supreme Court. Meanwhile, the dispute continues to cast a shadow over Nigeria’s international relations, particularly with China, a key economic partner.

     

    Amosun, who admitted to transferring the free trade zone to a subsidiary of Zhongshan in 2012, has maintained his innocence and urged the Tinubu government to resist the Chinese investors’ demands. Both Amosun and presidential representatives have so far declined to comment on the recent legal developments and the implications for Nigeria’s sovereignty and international standing.

    The Ogun State Police Command has apprehended two persons on suspicion of their involvement in cult-related activities in Sango-Ota, within the Ado-Odo-Ota Local Government Area of the state.

    The suspects, identified as Abiodun Salami and Destiny Adeola, were arrested by the Ogun State Anti-Robbery Squad after receiving a tip-off from residents in Ijoko.

    The state Command’s Public Relations Officer, Omolola Odutola, disclosed this on Monday, stating that the two individuals were apprehended on August 8, 2024.

    Odutola said that the suspects, along with other members of the Eiye Confraternity, had gathered at a location in Ijoko.

    He said “When they spotted the squad, they scattered in different directions. Salami and Adeola were apprehended.

    “During questioning, Adeola revealed that he was initiated into the Eye Confraternity in 2022 at Atan-Otan.

    Odutola stated that the police have intensified efforts to apprehend the other members who escaped.

    He noted that items recovered from the scene included a toy silver pistol, locally made amulets and suspected Indian hemp.

    President Bola Ahmed Tinubu has been scheduled to depart the nation’s capital today, August 19.

    A statement released by presidential spokesperson, Ajuri Ngelale, on Sunday night, said the President will return to the country after his brief work stay in France.

    This trip comes after the recent release of the Airbus A330, one of three presidential jets previously detained in France following a court order.

    The Chinese firm, Zhongshan Fucheng Industrial Investment Limited, which was involved in a legal dispute with Nigeria, allowed the release of the jet as a goodwill gesture to enable President Tinubu to attend the meeting in France.

    Sources that spoke with Premium Times revealed that the Airbus A330 landed at the presidential wing of the Nnamdi Azikiwe International Airport in Abuja at approximately 8:30 p.m. on Sunday.

    The aircraft was received by officials of Nigeria’s Presidential Air Fleet, led by Air Vice Marshal Olayinka Olusola.

    The Airbus 330, a multi-engine prestige jet, is now Nigeria’s Airforce One, with registration number 5N-NGA.

    The aircraft was purchased for over $100 million, significantly less than its estimated market value of $600 million.

    The deal was brokered by L & L International LLC, an aviation firm based in Miami, Florida.

    The acquisition of the new jet followed recommendations from the House of Representatives’ National Security and Intelligence Committee, which raised concerns about the safety and cost efficiency of the previously used 19-year-old B737-700 (BBJ).

    The committee recommended replacing some of the ageing and unserviceable aircraft in the presidential fleet to reduce downtime and operational costs.

    President Bola Ahmed Tinubu will depart for France on Monday, 19 August 2023, for a “brief work stay”, the Special Adviser to the President on Media and Publicity, Ajuri Ngelale, said in a statement yesterday. According to the statement, the President will be back in the country after his “brief” visit to the European nation.

    While Ngelale’s statement was silent on the details of the visit, it came a few days after a major development involving Zhongshan Fucheng Industrial Investment Co. Limited, a Chinese company that is in a legal tussle with Nigeria.

     

    In connection with the contract dispute between the company and the Ogun State government that began in 2016, the firm seized three aircraft belonging to Nigeria: a Dassault Falcon 7X, a Boeing 737-7N6/BBJ, and an Airbus A330-243.

    The Chinese firm had taken the issue to the international courts, which resulted in the order to detain the plane by a French court. Recently, Zhongshan Fucheng declared the release of one of the seized jets, an Airbus A330-243, following revelations that it was needed for President Tinubu’s upcoming meeting with French President Emmanuel Macron.

     

    In an emailed statement Friday, a spokesperson for Zhongshan Fucheng said it would always want to cooperate, stating, “Zhongshan has consistently sought to act reasonably and fairly in the course of a legal dispute with Nigeria which was not of its making.” The spokesperson said the seizure order against the Airbus A330-243 had been lifted as a “gesture of goodwill” to enable the President to travel.

     

    This will be the second foreign trip by President Tinubu within a week. The President had just returned to Abuja from a three-day official visit to Equatorial Guinea. The timing of the announcement and the release of the aircraft was a question of coordination between the Nigerian government and the Chinese firm—also with diplomatic and legal implications.

     

    There is a dearth of information concerning President Tinubu’s visit to France, coupled with the fact that no official statement has been made as regards the purpose or agenda for the visit.

    Investigations have revealed that the procurement of a new presidential jet for President Bola Ahmed Tinubu was completed without due process of approval from the National Assembly. Daily Trust findings have shown that the acquisition of the aircraft was made without consulting the legislative body.

     

    This online news platform reported last June that the Nigerian Government has fully paid an Airbus A330 aircraft that it has acquired from a German bank, having originally taken back by the bank from an Arabian Prince who failed to fulfill his financial commitment. The stated attained cost of the plane remained to be revealed, but speculations from previous reports indicated the plane costs $100 million.

    The controversy over the purchase of the aircraft took a different turn when a Chinese company, over a legal disagreement, and the Ogun State government seized three Nigerian planes on a French court order.

The House had just passed a supplementary budget bill raising the 2024 Appropriation Act from N28.7 trillion to N35.06 trillion, with no mention of any presidential jet.

     

    Those who spoke to Daily Trust among the lawmakers confirmed that no request or approval for the new jet was presented before the National Assembly. The source in the Senate informed that the matter was never discussed in the plenum and there was no knowledge of any approval.

     

    The hint that the acquisition was without the legislative approval did not bother the NSA spokesman, Zakari Mijinyawa. He, rather, reasoned out that the procurement would have come under Service Wide Vote.

    ‘Save Our Soul’

     

    In June 2024, NNPC sent a ‘save our soul’ message to the government over the negative impact subsidy payment had on its cash flow, informing the latter that it was barely keeping itself as a “going concern.” The firm attributed this to spiraling subsidy bills, which it claimed were due to “forex pressure” eroding its financials.

     

    NNPC’s Group Chief Executive Officer, Mele Kyari, said that with the removal of the subsidy in June 2023, an initial result of realizing monthly savings of about N400 billion for the federation was seen. This consequently helped the company remit a total amount of N2.032 trillion in taxes and royalties paid into a sequestered account at the Central Bank of Nigeria by January 2024. The savings were short-lived because of the continuous devaluation of the naira, which resulted in an increase in the NAFEX exchange rate.

     

    It was gathered that fuel importation was liberalized in August 2023, with the subsidy bill rising to N52.73 billion. The figure increased to as high as N665.60 billion by November and rose further to N693.67 billion by January 2024. The amount reduced slightly to N497.39 billion by the end of March. But the subsidy bill again jumped to N833.68 billion in April, which became so unbearable that Kyari had to write a letter to the President.

     

    He said the incessant pressure had strained the national energy security, and NNPC could not continue to supply petrol if the situation persisted beyond July 2024.

     

    All Efforts Not Working

     

    In his letter, Kyari broke down what would be done from August 2023 to April 2024: oil production optimization, debt rescheduling, deferment of payments to suppliers, and debt recovery. All of these were pursued to no avail, as the financial situation remained very gloomy; the projected cash flow deficit was majorly driven by the exchange rate fluctuations.

     

    NNPC is projected to owe N3.987 trillion in taxes and royalties by December 2024, while it will be left with a deficit of N2.897 trillion after deductions of its obligation and subsidy expenses. On June 6, 2024, the president approved the Kyari appeal to cover the subsidy cost using the 2023 final dividends and deferring 2024 interim dividends.

     

    An Admission of ‘Subsidy’

     

    The Presidency had earlier denied any plan to return the subsidy, amid reports to the contrary, under President Tinubu. The word “subsidy”, which the Muhammadu Buhari administration never used, instead opting for “under recovery”, made a comeback in official correspondence.

     

    The position of the current administration is still that “subsidy is gone”, though NNPC plans for the cost of subsidy to gulp over N5 trillion this year alone. It is in the face of this that the coming off of the petrol subsidy in June 2023, massive devaluation of the naira, and high crude oil prices have combined in a “doubly whammy” deal for NNPC.

     

    The NNPC keeps petrol prices within the N600-N700 per liter range by using some sort of “derived FX rate,” wherein the subsidy/FX differential is the difference between the derived FX rate and the official rate.

    The Kwara State Government has continued with the clampdown on environmental law offenders as the fine imposed on them has risen to N50,000, DAILY POST reports.

    Offenders are also liable to a three-month jail sentence instead of a fine.

    The offenders convicted last week between Tuesday and Friday were fined N20,000 or N10,000.

    The enforcement drive by the state Ministry of Environment, according to credible sources, is now a 24-hour exercise as the state government vows to keep Ilorin, the state capital, clean and free of infectious diseases from indiscriminate dumping of refuse at wrong locations.

    During a visit to the Ministry of Environment on Sunday, where the mobile court in charge of the trial of offenders is housed, relatives of the offenders were seen making frantic efforts to secure their bail.

    Members of the 300-man enforcement team led by the state Commissioner for Environment are out 24 hours, even at midnight, arresting offenders of the new environmental law, all in a bid to ensure adherence to the new law.

    Reports said medians and unauthorised locations are now being used as dumping areas by some residents of the state capital despite the new law.

    Twenty-one offenders were on Thursday convicted for flouting the new environmental law, while over 40 persons have so far been sentenced since the enforcement commenced.

    A 34-year-old notorious cultist, Adekunle Adebanjo, popularly called “Kunle Polly” has been arrested by the Ogun State Police Command over the alleged killing of a member of a rival group in Ijebu Ode.

    The spokesperson of the command, SP Omolola Odutola, disclosed this in a statement on Saturday, August 17, 2024.

    According to the PPRO, a concerned citizen made a distress call to the Divisional Police Station, Igbeba, on August 12, and reported that rival cultists fought each other during which the deceased called ‘Mosquito’ was shot, macheted, his left hand severed and taken away by his killers.

    The PPRO stated that Adebajo, who was suspected to be among the killers of Mosquito, was arrested at 12:03 am on  August 17, 2024, in his hideout at Isiwo Ijebu.

    She explained that credible information was provided by the public that enabled the police to track the fleeing suspects’ hideout.

    ”Upon receiving this information, a team of detectives promptly mobilised and took action by moving to the location, where one suspect, Adekunle Adebajo, aka Kunle Polly, 34, was apprehended,” the statement read.

    “During interrogation, Kunle Polly admitted to being a member of the Eiye confraternity.

    “This prompted a search to be conducted at his residence, leading to the recovery of a Beretta pistol with six rounds of live ammunition, two UTC axes, and charms.

    “Investigation is ongoing to unravel the pattern of severing the left hand of their victims, and to arrest other criminals that fled the hideout.

    According to Odutola, the suspect is presently undergoing preliminary investigation in Igbeba Division, Ijebu-Ode.

    “The Commissioner of Police, Abiodun Alamutu, has reassured the people that the era of cultism in Isiwo Ijebu community has gone.

    “Alamutu promised that the remaining suspects would be brought to justice for their crimes,” she added. .

    In a bid to boost food security, a delegation of the Niger State Government, led by Special Adviser on Social Investment Programmes, Hauwa Bako, embarked on a fact-finding visit to Soilless Farm Labs in Ogun State.

    The Special Adviser to the Governor on Digital Media and Strategy, Abdullberqy Usman Ebbo, made this disclosure in Minna.

    He explained that the visit was aimed at exploring innovative solutions and best practices to enhance the successful implementation of the state’s agricultural policies.

    Ebbo stated: “The visit was one of the strategies of the state to become one of Nigeria’s leading agricultural hubs, exploring innovative practices such as soilless farming to achieve the planned goal.”

    According to him, the team inspected the state-of-the-art facilities, met with training participants, and held productive discussions with partners involved in the Enterprise for Youth in Agriculture.

    The governor’s aide also disclosed that during a visit to former President Olusegun Obasanjo at his residence in Abeokuta, Ogun State, he applauded Governor Mohammed Umar Bago for his agricultural revolution policy to ensure food security is achieved in the country.

    “Until Nigeria begins to feed itself, the challenges facing the country will continue. A nation that cannot feed itself is sitting on a time bomb,” he noted.

    Ebbo further revealed: “Obasanjo advised other state governors to emulate Niger State’s lead in agricultural development to ensure the country is able to feed its population, thereby exporting food to boost its GDP. He also encouraged Niger State government to sustain investment in agriculture.”
