Obi Vs Tinubu: We Haven’t Received The CTC Of Your Judgement – LP To Supreme Court

Labour Party Expresses Concern Over Delayed Delivery of Supreme Court Judgment

The Labour Party (LP) has raised a significant alarm over the delayed issuance of the Certified True Copy (CTC) of the judgment delivered by the Supreme Court several months ago, regarding an appeal it filed alongside its presidential candidate, Mr Peter Obi.

In a press release dated November 28, 2023, the LP expressed deep concern and dissatisfaction regarding the status of the judgment.

The party highlighted the sequence of events surrounding the Supreme Court’s handling of the appeal, citing the discrepancy between the LP’s case and a separate appeal brought by the Peoples Democratic Party (PDP).

The LP noted that despite being two distinct appeals emanating from separate judgments at the Court of Appeal, the Supreme Court, after delivering judgment in the PDP’s case, orally indicated that the decision would also apply to the LP’s appeal.

The party expressed astonishment over the Court’s stance, highlighting several discrepancies between the LP’s appeal and the PDP’s case. These included varying factual grounds, different issues submitted for determination, and specific concerns unique to the LP’s petition.

The LP further detailed its efforts to obtain a Certified True Copy of the judgment, citing multiple requests to the Chief Registrar of the Supreme Court.

However, to date, these requests remain unaddressed, contravening the constitutional provision requiring the court to furnish parties with authenticated copies of its decisions within seven days of delivery.

The LP underscored its disappointment with the Supreme Court’s handling of the matter, labeling it as unprecedented and a violation of its constitutional right to a fair hearing.

The party’s National Secretary, Alhaji Umar Farouk Ibrahim, lamented the situation, terming it as an “unmitigated breach” of their rights and expressed deep concern over the Court’s conduct.

The LP’s press release urged swift action by the Supreme Court to provide the Certified True Copy of the judgment, emphasizing the importance of upholding the constitutional rights of all parties involved.

APC’s Bako Kasim Declared Winner as Appeal Court Sacks PDP’s Suleiman Wanchiko in Niger Assembly Election.

The Court of Appeal in Abuja has overturned the victory of the Peoples Democratic Party’s Suleiman Wanchiko in the Bida I (North) State Constituency election in Niger State. The court declared Bako Kasim of the All Progressives Congress as the rightful winner of the poll.

The three-member panel, led by Justice Bature Isa-Gafai, delivered the judgment, stating that Mr. Wanchiko’s appeal lacked merit.

The decision followed Mr. Kasim’s counsel, Johnson Usman, SAN, successfully arguing that Mr. Wanchiko, who presented a forged testimonial to the Independent National Electoral Commission (INEC), should be disqualified from contesting the election.

INEC initially declared Mr. Wanchiko the winner of the March 18 Assembly election with 12,062 votes against Mr. Kasim’s 11,820 votes.

Dissatisfied with this outcome, Mr. Kasim and the APC approached the state’s election petition tribunal, citing Mr. Wanchiko’s disqualification due to a forged testimonial and alleged non-compliance with the Electoral Act 2022.

The tribunal, after thorough consideration, found merit in the petitioners’ arguments, disqualified Mr. Wanchiko, and ordered a re-run without his participation. Unhappy with this decision, Mr. Wanchiko appealed to the Court of Appeal, seeking to set aside the tribunal’s judgment.

However, the appellate court upheld Mr. Usman’s argument, maintaining that Mr. Kasim, having been disqualified, should be declared the rightful winner of the poll. The court directed INEC to issue Mr. Kasim a Certificate of Return. This legal outcome reshapes the representation of Bida I (North) State Constituency in the Niger State Assembly.

Boko Haram Ambush Claims Lives of 11 Wood Loggers in Damboa, Borno State

Suspected Boko Haram members riding on camels ambushed and beheaded at least 11 local wood loggers in Damboa Local Government Area of Borno State. The brutal incident unfolded near Bale, a remote village, on Monday.

According to a reliable source within the local vigilante group, the assailants callously rejected pleas for mercy, resulting in the instant and gruesome killing of six wood loggers. Their dismembered bodies were discovered at the scene around 5 pm.

“We found six bodies of the wood loggers who were butchered by the Boko Haram people from the location on Monday evening. We do not think any of them survived the attack. Their bodies were badly dismembered, and we found them in a pool of blood as all parts of their bodies were cut into pieces,” shared the source.

Despite the horrific discovery, five wood loggers are still missing, and the vigilante group holds hope that they may have escaped the attack. The assailants, reportedly arriving on camels, surrounded the victims, leaving behind approximately 15 camel footprints.

“We learnt that some of the lucky loggers ran as fast as they could, though they were pursued by the Boko Haram members. Why we also believe the others escaped is because camels don’t run as fast as horses, and more importantly, the victims are familiar with the terrain; that’s why we’re praying that they escape,” explained another member of the vigilante group.

Breaking: Appeal Court Sacks Two PDP Lawmakers, Orders Rerun

During the plenary on Tuesday, Senate President Godswill Akpabio read the letter, which outlined the intended use of the funds across various sectors. The projects targeted for funding include infrastructure, agriculture, health, water supply, roads, security, employment generation, and financial management reforms.

President Tinubu highlighted the importance of swift approval by the National Assembly to ensure the timely implementation of these crucial projects.

“I write in respect of the above subject and to submit the attached Federal Government 2022-2024 external borrowing plan for consideration and early approval of the National Assembly to ensure prompt implementation of the projects,” the letter stated.

The borrowing plan, totaling $8,699,168,559 and €100 million, aims to address critical areas contributing to the socio-economic development of the country. Emphasizing economic evaluations, employment generation, and skills acquisition, the President underscored the necessity of Senate approval.

“Given the nature of these facilities, and the need to return the country to normalcy, it has become necessary for the Senate to consider and approve the 2022-2024 external abridged borrowing plan to enable the government to deliver its responsibility to Nigerians,” the letter added.

This follows a previous request from President Tinubu, where he sought approval for $7.8 billion and €100 million in the Federal Government’s borrowing plan. The projects and programs included in the plan are strategically chosen to contribute significantly to the nation’s development.

The Senate will now deliberate on the request, considering the economic impact and benefits of the proposed borrowing plan before making a decision.
