Election: INEC Explains Relationship Between BVAS And IReV says they are different entities

INEC has stated that its Results Viewing Portal (IReV) and the Bimodal Voter Accreditation System (BVAS) are two separate and independent entities.

Professor Mahmood Yakubu’s Chief Press Secretary, Rotimi Oyekanmi, made this information public on Thursday.

Oyekanmi told Ejes Gist News Nigeria that the only connection between the two is that the BVAS is used to transmit election results from polling units to the IReV at the conclusion of voting.

However, he refuted claims that malfunctions with IReV during the February 25 elections negatively impacted the functionality of the BVAS.

“There is also a provision for the BVAS to transmit the PU result in offline mode if there is no network at the polling unit during the activity,” he explained.

The INEC Result Viewing portal IReV and the BVAS are two distinct entities that operate independently of one another.

“The BVAS transmits the image of Form EC8A, which is the Polling Unit Result Sheet in PDF format, and the Voters’ Accreditation Data to the IREV.

“Therefore, the glitches experienced by the IReV for a few hours on February 25 could not have affected the functionality of the BVAS, which performed admirably on election day in any case.”

Permanent Voter Cards (PVCs) were recovered by the 9 Brigade of the Nigerian Army from an apartment in the Olodi-Apapa neighborhood of Lagos State.

In addition to the PVCs, security personnel discovered ballot papers, cutlasses, and Indian hemp in the apartment, and arrested three individuals, while the primary suspect remained at large.

Brigadier General Isang Akpaumontia, who paraded the suspects and recovered items in front of journalists at the Ikeja Cantonment, disclosed that the arrest and recovery were the result of a tip.

He observed that the majority of the PVCs had the year 2022 as the registration number, while others had 2011, 2012, and 2021, and that all of the owners were Lagos State residents.

Akpaumontia explained that the suspects were apprehended in the general area of Apapa with drugs, daggers, charms, and over 1,000 PVCs. The owner of the residence, who is the prime suspect, was tracked to a hotel, but he managed to escape. He added that the suspects and evidence would be turned over to the proper authorities to ensure justice and deter others from engaging in similar activities.

As PVCs are required for eligible voters to participate in elections, their recovery has raised concerns regarding the integrity of the electoral process. The incident has prompted calls for increased security and vigilance to safeguard the electoral process.

It is unknown why the suspects were in possession of such a large quantity of PVCs and ballot papers, and investigations are ongoing to determine their motivations and whether they were acting alone or as part of a larger network.

Apostle Johnson Suleman of Omega Fire Ministries has backed the court action instituted by the Labour Party, LP, presidential candidate, Peter Obi.

Suleman was reacting to an old video that has gone viral of him asking candidates to forget about pursuing legal action in a bid to reclaim their stolen mandate.

The clergyman said the viral video was part of his message in 2015 and 2019, stressing that it’s not current.

There are plans to cause total chaos in the country after governorship, State Assembly elections — DSS raises alarm

The Department of State Services (DSS) says there are “orchestrated plans” to cause a total breakdown of law and order in the country.

The security agency said the plot is designed for execution after the governorship and state assembly elections.

In a statement released on Wednesday by Peter Afunanya, DSS spokesperson, the security agency decried the “unnecessary palpable political tension” in parts of the country.

“It is observed that some of the players are at daggers drawn with one another. The development holds dire consequences to national peace and stability.

It is in view of these that the Service warns politicians and their supporters to engage constructively,” the statement reads.

“Everyone is advised to shun fake news, hate speech and such other utterances that may be inimical to peaceful co-existence. Election should not be seen as a do-or-die affair. There is no basis for anyone to take laws into their hands.

“This is even more so that aggrieved persons can take advantage of our courts and seek redress. We should have faith in our institutions. Over this election period, the Service has remained committed to providing conducive environment for a peaceful exercise.”

“For the avoidance of doubt, the Service will work to make sure that no person or group, no matter how highly placed, disrupts the scheduled elections in any part of the Federation. It is committed to the safety and security of citizens who may wish to go out to exercise their civic responsibility.”

The DSS called on all Nigerians to abide by the rules of the Electoral Act and extant guidelines.

Breaking: Peter Obi Records First lost As Court gives INEC nod to reconfigure BVAS

The Court of Appeal, however, ordered INEC to upload the data on the BVAS machines to the back-end server and make certified true copies of the data to the respondents.

The court had restrained INEC from tampering with the BVAS machines data.

Pay Attention to Afenifere Rejects Tinubu’s Victory, Insists Peter Obi Won

On Wednesday, the Court of Appeal in Abuja granted INEC permission to reconfigure the Bimodal Voter Accreditation System (BVAS) machines used in the country’s presidential and National Assembly elections on February 25.

Chatham House blasts INEC over failure to upload results from polling units

A three-member appellate court panel led by Joseph Ikyegh granted the electoral body permission to reconfigure the machines ahead of Saturday’s governorship and Houses of Assembly elections across the federation’s 36 states.

The panel, however, directed the Independent National Electoral Commission (INEC) to upload the data from the BVAS machines to the back-end server and provide respondents with certified true copies of the data.

The court had earlier granted an order permitting the Peoples Democratic Party (PDP) presidential candidate, Abubakar Atiku, and his Labour Party rival, Peter Obi, to inspect the BVAS machines and other sensitive electoral materials.

Read Also JUST IN: Police arraign Prominent APC federal lawmaker for Money laundering

The opposition candidates who finished second and third behind the All Progressives Congress (APC) president-elect, Bola Tinubu, had requested access to the electoral materials before filing petitions in court to challenge the results of the 25 presidential elections.

In addition to granting them access to the materials, the court in its ruling on 3 March barred INEC from tampering with the BVAS machines pending the candidates’ inspection.

However, on March 4, INEC filed an ex parte application requesting that the Court of Appeal reverse the ex parte order in favour of the PDP and Labour Party candidates.

INEC asked the court to modify the order so that it could reconfigure the BVAS machines for the governorship and state house of assembly elections on March 11th.

According to INEC’s lawyer, Tanimu Inuwa, a Senior Advocate of Nigeria (SAN), the application became necessary as a result of an order prohibiting it from tampering with the information embedded in the BVAS machines until the required inspection and certification was completed.

He also stated that the commission would need enough time to reconfigure the BVAS in order to conduct the election on Saturday.

In court, he stated that INEC would upload from the back end.

In his argument, Mr Obi’s counsel, Onyechi Ikpeazu, a SAN, urged the court not to grant INEC’s application, which he claimed would result in the loss of the data they sought.

“All we are asking for is a physical inspection of the BVAS so that we can obtain evidence before it is configured,” he told the court.

As a result, he objected to the INEC application and urged the court not to grant it.

After hearing their arguments, the appellate court’s three-member panel adjourned the case until Wednesday for a decision.

Afenifere Rejects Tinubu’s Victory, Insists Peter Obi Won

…..Supports Obi’s decision to challenge Tinubu’s declaration in court

    …Disowns congratulatory message

…Vote Rhodes-Vivour, in Lagos, he’s of Yoruba origin

The Pan Yoruba Socio-Political Group, Afenifere, yesterday insisted that the Presidential election, held on February 25, was won by the Presidential candidate of the Labour Party, Peter Obi and not the candidate of the All Progressive Congress, Asiwaju Bola Tinubu.

It therefore, said that the decision of Obi to challenge the results of the election in court, has the group’s support

This was contained in a communique issued after its Special General Meeting, held, at Isanya-Ogbo, Ogun State, on Tuesday.

The communique which was signed by its National leader and Secretary General, Pa Ayo Adebanjo and Chief Sola Ebiseni, respectively, denied sending any congratulatory message in the name of the group to any candidate.

According to the group” the results of the lawful votes at the election available to the Afenifere through credible sources confirm that His Excellency Peter Gregory Obi, the Presidential candidate of the Labour Party, won the said election and we thus support his decision challenging the contrary Declaration by the INEC.

” The General Meeting hereby denounce in strong terms and dissociate Afenifere from any congratulatory message in the name of the Organisation or howsoever to any candidate as illegally declared by the INEC.

” Afenifere reiterates that for equity, fairness, national cohesion and peaceful corporate existence, the next President of the Federal Republic of Nigeria shall be person of its Southern part and specifically the South East.

” We call on Nigerians to troop out enmasse and participate fully in the Gubernatorial and Houses of Assembly elections slated for the 11th March 2023.

“That with particular reference to Lagos State, Afenifere confirms that the Governorship candidate of the Labour Party, Mr. Gbadebo Rhodes-Vivour is a person of Yoruba origin, whose great- grandparents are not only Yoruba but definitely one of the notable founding families of Lagos.

“We unequivocally endorse and urge the people of Lagos to vote for him.

Reviewing, the last elections, the group lamented that the deliberate non-compliance INEC with it’s guidelines encouraged electoral brigandage at the polling units.

These according to them include “destruction of ballot papers, snatching of ballot boxes, doctoring of figures and swapping of votes of candidates at the coalition centres through the amended and outlawed manual procedures which rendered the 25th February 2023 Presidential and National Assembly elections flawed in several respects as confirmed by local and international observers.

Afenifere, therefore, called “on INEC to ensure free and credible Gubernatorial and Houses of Assembly elections in accordance with the constitution, the extant Electoral Act and its mandatory Guidelines earlier mentioned.

“That in accordance with the hallowed Yoruba culture of civilised conduct, Afenifere assures all persons resident in Yorubaland, indigenes and non-indegenes, of protection in the conduct of their lawful duties and particularly the free exercise of the rights to vote for candidates of their choice in all elections and thus warn all threats mongers and merchants of violence to desist therefrom.

They called on the President Muhammadu Buhari and all security agents to guaranty the safety of the people, free, fair and peaceful elections throughout Nigeria.

The group said that ” the international community should show special concerns in the on-going electioneering process in Nigeria in the interest of peace of the global community.

Tinubu did intelligent rigging, while Peter Obi rigged the entire South-East without conscience — Reno Omokri

Reno Omokri, former President Goodluck Jonathan aide has claimed that Peter Obi, the presidential candidate of the Labour Party was the main rigger of the 2023 presidential election.

Omokri disclosed this in a post he made on twitter.

    He said:

The Peter Obi that is shouting everywhere that he was rigged out is saying nothing of those areas in the SE where he got 97% of the votes. Where else did that happen during #NigerianElections2023? Yes, this election was rigged. But Obi was the main rigger-in-chief”

“Tinubu did intelligent rigging. At least he used his conscience to give small votes to other candidates. Peter Obi’s rigging was so unintelligent. In the history of Nigeria, when and where have you heard of a candidate getting 97% in some areas in the SE?

The Presidential Election Petition Tribunal (PEPT) has granted the request of President-elect Asiwaju Bola Tinubu and his party, the All Progressives Congress (APC), to inspect election materials from February 25.

On Wednesday, a three-member panel of the appeal court granted the reliefs sought by Tinubu and APC in their fourth motions ex-parte, with the exception of Tinubu’s prayers 5 and 6.

Meanwhile, Peter Obi, the Labour Party, LP presidential candidate, has urged his supporters not to use the court as a rallying point.

Obi would be physically present at the Appeal Court today for the hearing on the Independent National Electoral Commission’s (INEC) application to set aside an earlier order granting Obi and Atiku Abubakar of the Peoples Democratic Party (PDP) permission to inspect the Bimodal Voter Accreditation System (BVAS) machines.

  • Chatham House blasts INEC over failure to upload results from polling units

Chatham House blasts INEC over failure to upload results from polling units

Chatham House blasts INEC over failure to upload results from polling units

Chatham House, an independent policy institute based in London, has stated that from its analysis of the February 25 presidential election, it would appear that the Independent National Electoral Commission (INEC) failed to learn new lessons.

The organisation stressed that the electoral umpire failed to adhere to its own guidelines, which it enunciated before the poll, especially the one bordering on the uploading of results in real-time.

The London-based institute made the assertions just as Fitch Solutions lowered Nigeria’s Social Stability score in its proprietary Short-Term Political Risk Index (STPRI) to 17.5 out of 100, down from the 25.0 previously projected, following what it described as the aftermath of the “weak” mandate claimed by the country’s president-elect, Bola Tinubu.

INEC had last Wednesday announced the former Lagos State governor as winner of the keenly contested presidential poll. However, the contending parties refused to accept the verdict of the electoral umpire.

While the presidential candidate of Labour Party (LP), Mr. Peter Obi, approached the courts to overturn the result, the Peoples Democratic Party (PDP) candidate, Mr Abubakar Atiku, who had also announced plan to challenge the outcome of the election in court, led a protest against the result on Monday.

Stating that Nigeria’s presidential election results had put disenfranchisement in the spotlight, Chatham House noted that despite boasting the biggest electoral register in Africa of 93.4 million voters, fewer than 25 million valid votes were counted in Nigeria’s 2023 election.

Writing for the body, the Associate Fellow, Africa Programme, Dr. Leena Koni Hoffmann, noted that the delayed opening of polls meant that many potential voters were not able to vote.

Chatham House, also known as the Royal Institute of International Affairs, prides itself as an independent policy institute headquartered in London. Its stated mission is to provide commentary on world events and offer solutions to global challenges.

Founded in 1920, Chatham House engages governments, the private sector, civil society and its members in open debates. All the major presidential candidates in Nigeria were visitors to the organisation before the presidential election.

According to Chatham House, the results announced by chair of INEC, Mahmood Yakubu, showed that the incumbent APC candidate, Tinubu, received 8.87 million votes – roughly one-third of the total.

His main challengers, Atiku of PDP, in his sixth attempt, and Obi of LP, the organisation said, garnered 7 million and 6.1 million votes, respectively.

Hoffman wrote, “The INEC’s performance and controversies over these results mean that the electoral reforms and lessons declared to have been learned were not fully applied and, as an electoral body, it was significantly less prepared than it claimed.

“The logistical failures of INEC and widespread delayed opening of polling units meant that voters who showed up at the polls early were frustrated and many voters and INEC staff were not able to locate their polling units for several hours.”

Chatham stated that Nigerians queued in the sun and rain to cast their votes, despite recurrent fuel crisis, epileptic power supply, record inflation, and a painful cash crunch.

Yet it noted that thousands of voters were disenfranchised, and multiple irregularities were recorded as well as intimidation and violence as noted by election observers.

Chatham House stated, “Less than half of eligible voters could participate in the elections, despite the commission’s N305 billion budgetary allocation. While Nigeria’s youth seemed energised leading up to the elections, it seems their ability to turn out is still being hugely constrained by how difficult and potentially dangerous it is to cast a vote in Nigeria.

“The INEC’s performance and controversies over these results mean that the electoral reforms and lessons declared to have been learned were not fully applied

“At just 25.7 per cent, the elections have the lowest recorded turnout of any election since Nigeria returned to democracy in 1999, despite being the most expensive. These dwindling numbers highlight how Nigeria’s politics and state institutions continue to exclude rather than include.”

The commission’s patchy deployment of technology in the use of a Bimodal Voter Accreditation System (BVAS), Chatham House stated, was still being intensely scrutinised and criticised.

“It failed to adhere to its own statements and guidelines, which derive from its laws, that election results would be uploaded to its portal using the BVAS directly from the polling unit in real-time for the public’s viewing,” Chatham House added regarding INEC.

Having just 23 per cent of the public’s trust going into the 2023 election, Chatham noted that the need for strict transparency by INEC in this crucial phase of electronic results transmission could not be overstated and should not be downplayed.

INEC’s sub-optimal performance, the organisation said, must be taken seriously because Nigeria’s path to recovery and stability must follow the way of accountability and electoral integrity.

It added that when sworn in, Tinubu would inherit a country made weaker economically, less secure, and diminished in stature under the leadership of his party.

The monumental challenges that weigh Africa’s most populous country, Chatham said, would not be easy for any leader, adding that the Nigerian people – especially the country’s youngest – have demonstrated strong resilience and have waited for far too long for a country that works for them.

The organisation stated, “Tinubu’s party first came into power in 2015 through a campaign of change and he has won in 2023 by running a campaign for renewed hope. But many of the issues that worried the Nigerian electorate in 2015 are a bigger headache in 2023 – significantly due to the self-inflicted fiscal and monetary decisions of the president he will be succeeding.

“In the months leading up to his swearing, Tinubu needs to marshal an extraordinary amount of political capital, goodwill and consensus to redirect and reunite a fractured and volatile Nigeria.”

Election Aftermath: Fitch Downgrades Nigeria’s Short-term Social Stability Index to 17.5%

Fitch Solutions lowered Nigeria’s Social Stability score in its proprietary Short-Term Political Risk Index (STPRI) to 17.5 out of 100, down from the 25.0 previously projected, following what it described as the aftermath of the “weak” mandate claimed by the president-elect.

In its latest Country Risk & Industry Research, the global group also downgraded Nigeria’s overall STPRI from 42.1 to 40.2, maintaining that political risks are expected to rise in Nigeria as a result of Tinubu’s victory.

Fitch stated that as it had projected, Tinubu – the candidate of the ruling All Progressives Congress (APC) – was declared the winner of Nigeria’s presidential election on March 1, 2023. It added that despite opposition parties calling for a re-run of the presidential election, it believed that chances of this happening were slim.

According to the organisation, reduced trust in the electoral process and Tinubu’s weak political mandate would increase social unrest in the immediate term.

The Fitch report stated, “In line with the Fitch Solutions’ view, Bola Ahmed Tinubu – the candidate for the ruling All Progressives Congress (APC) – was declared the winner of Nigeria’s presidential election on March 1 2023.

“As we had predicted, the popularity of the Labour Party (LP)’s candidate – Peter Obi – split the opposition vote at the expense of Atiku Abubakar, the candidate for the PDP.

“Indeed, Obi received the largest share of votes in many states in Nigeria’s South-south and South-east regions, which were PDP strongholds in previous elections.

“However, Tinubu received a weak mandate. With all states now reporting, Tinubu received just 36.6 per cent of the national vote. This is the first time since the return of democracy in 1999 that a president has been elected with less than 50 per cent of the vote, and the lowest share received by an election winner since 1979.”

Furthermore, the report noted that opposition figures had criticised the conduct of the vote and were demanding that the election be re-run.

While international observers had not described the vote as rigged, Fitch explained that they had reported that the election was characterised by operational failures and a lack of transparency.

It added that opposition parties had been particularly critical of the fact that INEC did not post individual polling station figures to a website that was meant to ensure transparency.

Besides, Fitch explained that it believed that the low voter turnout of an estimated 29.0 per cent – the lowest turnout on record – at a time when voter enthusiasm was high, will give rise to the perception that widespread voter suppression took place.

A coalition of opposition parties led by PDP and LP, Fitch said, had already called for the cancellation and re-run of the election.

It added that statements by INEC, however, suggested that the institution would stand by the official results, with INEC officials having stated that allegations of electoral fraud were “unfounded and irresponsible” and that the results point to “a free, fair and credible process.”

The report said this suggested that there was limited appetite within the commission to hold new elections, noting that, indeed, holding a re-run would be extremely costly, as the commission’s 2023 election budget totalled N305 billion ($660 million) – likely discouraging a re-run.

Fitch stated that it expected that protests were likely over the short term, particularly in urban areas, such as Lagos, stressing that the Labour Party drew significant support from members of the #EndSars protest movement, which launched a series of protests in the commercial capital in 2020.

The Fitch report stated, “Given that several pre-election polls showed the Labour Party’s candidate winning the vote, we expect that the party’s youthful supporters are likely to be dissatisfied with the result.

“It is also possible that the Labour Party and PDP may boycott or disrupt gubernatorial elections scheduled for 11 March 2023. Much will depend on how Peter Obi and other opposition figures react over the coming days.

“Taking this into account, we have lowered Nigeria’s Social Stability score in our proprietary Short-Term Political Risk Index (STPRI) to 17.5 out of 100, from 25.0 previously (lower score implies higher risk). This brings Nigeria’s overall STPRI from 42.1 to 40.2.

“Given Tinubu’s weak political mandate and widespread opposition to his government, we doubt that the incoming administration will launch any serious economic reforms in 2023.”

Fitch further forecasted that inflation would average 18 per cent in 2023 – and Tinubu’s weak political mandate would discourage him from implementing strong economic reforms in the short term.

Fitch predicted., “Indeed, the liberalisation of Nigeria’s exchange rate regime and the removal of the fuel subsidy would put upside pressure to inflation and would likely lower the president’s already weak support base – something we believe Tinubu will seek to avoid.

“Indeed, given divisions within the legislature, widespread political opposition and concerns about the president-elect’s health, we expect a long period of political stasis.”
