  • How The Charcoal Producer Associations President In Gombe Landed In Jail Over N7Million Fraud

    Justice H.H. Kereng of the Gombe State High Court in the state capital has handed down a one-year prison sentence to Edu Babatunde Azeez, the President of the National Association of Charcoal Producers and Exporters (NACPE).

    Azeez and his company, Ablims Limited, were convicted after pleading guilty to two counts of conspiracy and obtaining under false pretences, upon being arraigned by the Gombe State Zonal Command of the Economic and Financial Crimes Commission (EFCC).

    The arraignment followed a petition filed against him and his company by one Ayanbisi Ismail, where the petitioner alleged that he defrauded him of the sum of N7,183,750 and all efforts to get his money back proved abortive.

    The two counts preferred against Azeez and his company state: “That you Edu Babatunde and Ablims Limited sometime in December 2022 at Gombe, Gombe State within the jurisdiction of this honourable court fraudulently obtained the sum of N7,183,750 from one Ayanbisi Ismail by falsely representing the money to be for exporting charcoal to Saudi Arabia, a representation which you knew to be false and thereby committed an offence contrary to Section 320 and punishable under Section 322 of the penal Code Law.

    “That you Edu Babatunde and Ablims Limited sometime in December 2022 at Gombe, Gombe State within the jurisdiction of this honourable court  conspired amongst yourselves to do an illegal act to wit: cheating and thereby committed an offence contrary to Section 96 and punishable under Section 97(2) of the Penal code Law.”


    Upon pleading guilty to the charges, prosecution counsel, A.B. Kware, asked the court to convict and sentence Azeez as charged, but counsel for the defendant, Inusa Mahammed, pleaded with the court to temper justice with mercy as the defendant is a first-time offender.

    In his ruling, Justice Kereng convicted and sentenced Azeez and his company, Ablims Limited to one year imprisonment with an option of N200,000 as a fine.

    President Bola Tinubu eliminated fuel subsidy entirely on May 29, 2023, during his inauguration, leading to a sharp increase in petrol prices nationwide. The removal of subsidy was intended to open up petrol imports to the private sector, as stipulated in the Petroleum Industry Act 2021, thereby breaking the NNPCL’s monopoly on petrol importation.

    However, due to challenges in obtaining foreign currency, private oil firms have been unable to engage in significant importation, leaving the NNPCL as the sole importer of petrol in Nigeria once again.

     

    Despite earlier announcements by the NNPCL indicating a shift away from sole supplier status, the company has resumed its monopoly, citing challenges faced by oil marketers in managing price volatility in the downstream sector.

    Recent observations reveal persistent fuel queues in major cities like Lagos, Abuja, and Kaduna, with some independent petrol stations experiencing shortages.

    The NNPCL has assured the public of regular supply, urging against panic buying and emphasizing sufficient product availability. However, reports from independent marketers indicate irregular supply in recent days, raising concerns among consumers.

     

    Various reasons have been cited for the scarcity, including logistics issues impacting petroleum product supply, demands for increased haulage costs by transportation associations, and fluctuations in global oil prices. Despite assurances from the NNPCL and industry associations, the situation persists, disrupting transportation and causing inconvenience for motorists nationwide.

     

    Efforts by the NNPC Retail Limited to address supply issues have been ongoing, with promises of normalization within affected areas. However, the impact of these efforts remains to be seen as consumers continue to grapple with the effects of fuel scarcity on their daily lives.

  • Interior Minister, Olubunmi Tunji-Ojo Visits Suleja Prison After Escape Of 119 Inmates

    Minister of Interior, Olubunmi Tunji-Ojo, paid a visit to Suleja Medium Security Custodial Centre, on Thursday, after over 119 inmates escaped from the facility during a downpour.

    The Minister visited the facility to assess the extent of damage caused by the rain on Wednesday which pulled down parts of the prison’s perimeter fencing and facilitated the escape of the inmates.

    As earlier reported, the escaped inmates took advantage of the broken walls caused by the rains and escaped the prison facility on Wednesday.

    It was gathered that ten of the escaped inmates have been re-arrested and returned to the facility, while a manhunt has been launched by the Nigerian Correctional Service (NCoS) authorities together with other security agencies to smoke out the fleeing escapees from their hideouts.

    During the visit on Thursday, the Minister sought to know steps being taken to arrest the fleeing inmates and bring them back to the centre.

    Those in the entourage of the Minister include the Interior Ministry’s director of joint services, Peter Egbodo and other top officials of the Nigerian Correctional Service (NCoS) who were on hand to receive the minister and his team.

    Meanwhile, more security personnel have also been drafted to the surroundings of the facility while the areas have been cordoned off.

  • Stop Misusing Ex Parte Order – Akpabio Tells Judges

    President of the Senate, Godswil Akpabio has urged judges in the country to stop ”misusing” ex parte orders, especially in political cases.

    He stated that there should be punishment for erring judges involved in the abuse.

    In his speech titled “Repositioning the Justice System, Constitutional, Statutory and Operational Reforms for Access and Efficiency” at the National Summit on Justice in Abuja on Wednesday, April 24, Akpabio noted that it is imperative for the National Judicial Council (NJC) to exercise stringent oversight to curb the misuse of ex parte order.

    He said;

    “We recommend prompt and decisive punishment for erring judges who are found to be involved in this abuse. We further propose that the NJC establish clear and detailed standards governing the issuance of ex parte orders, accompanied by a defined set of sanctions for violations. These sanctions should be severe enough to deter people from future abuses.

    “We recommend that the NJC should conduct regular audits and reviews of ex-parte orders issued by judges to ensure compliance with established standards.

    “As was done in the criminal jurisprudence during the enactment of Administration of Criminal Justice Act, 2015, we propose that all appeals in civil cases should be taken only after the conclusion of the substantive case.

    “This change will accelerate judicial processes, reduce backlog, and ensure that litigations are not unduly prolonged by intermediate appeals.

    “Another area requiring urgent reform is the process of obtaining the Attorney General’s consent before executing judgments. This requirement often acts as a bottleneck, delaying justice and undermining the autonomy of our judicial system. We propose modifying this requirement to facilitate a swifter execution of judgments, thereby enhance the efficiency and effectiveness of our justice system.”

    Akpabio also said that such reforms will foster trust in the justice system and improve the overall efficiency of legal proceedings involving the government.

    He added;

    “This integration will not only fortify our constitution and electoral framework but will also ensure that justice both in letter and in spirit becomes more attainable for every Nigerian.

    ”The national Assembly is not unaware of the delays and backlogs plaguing the courts, adding that the issues make justice to be seen as inaccessible and inefficient.”

  • Alleged Fraud: EFCC Withdraws Appeal Against Yahaya Bello

    The Economic and Financial Crimes Commission (EFCC) has withdrawn its application against the immediate past governor of Kogi state, Yahaya Bello at the Court of Appeal.

    The EFCC said the notice of withdrawal is predicated on the fact that the application filed has been overtaken by the decision of the Kogi State High Court.

    This was made known in a court application filed on Tuesday at the Court of Appeal Abuja judicial division by J. S. Okutepa, SAN and others on behalf of thCommissionon.

    The Commissionon said the subject of the appeal had been determined by the Kogi High Court Judge, Justice Jamil J., on April 17, 2024.

    The EFCC, therefore, told the court that the notice of appeal was filed out of time and now prays that the appeal be struck out as incompetent.

    It said: “The appellant herein intends to and do hereby wholly withdraw her appeal against the respondent in the above mentioned appeal.

    “This notice of withdrawal is predicated on the fact that; on the April 17, 2024, the application filed by the appellant herein was overtaken by the decision of the same high court of Kogi state.

    “The orders made ex parte by Jamil on the Feb 9, 2024 in the said suit which is the subject of this appeal, was made to last pending the hearing and determination of the originating motion on notice which was finally determined by Jamil J. on the April 17, 2024.

    “Furthermore, the notice of appeal was filed out of time and we, therefore, pray that the appeal be struck out for being filed out of time and incompetent.”

    On February 8th, Bello instituted a fundamental rights enforcement suit, asking the court to declare that “the incessant harassment, threats of arrest and detention, negative press releases, malicious prosecution” of the EFCC — “without any formal invitation — is politically motivated and interference with his right to liberty, freedom of movement, and fair hearing”.

    The former governor also sought an order “restraining the respondent by themselves, their agents, servants or privies from continuing to harass, threaten to arrest or detain him”.

    On February 9, the Kogi High Court granted an interim injunction restraining the EFCC from “continuing to harass, threaten to arrest, detain, prosecute Bello, his former appointees, and his staff or family members, pending the hearing and determination of the substantive originating motion for the enforcement of his fundamental rights”.

    On March 12, the EFCC filed an appeal against the interim injunction because the court could not stop the commission from carrying out its statutory responsibility.

    The Kogi High Court delivered judgement on the substantive motion on notice on April 17. The presiding judge, Isa Jamil Abdullahi, granted an order restraining the EFCC “from continuing to harass, threaten to arrest or detain Bello.”

    However, the judge directed the commission to file a charge against Bello before an appropriate court if it had reasons to do so.

    An All Progressives Congress, APC, governorship aspirant in Ondo State, Wale Akinterinwa, has said he will honour the invitation of the Economic and Financial Crimes Commission, EFCC, on Thursday.

    DAILY POST reports that Akinterinwa, who contested with 15 others for the party’s governorship ticket last Saturday, was invited by the anti-graft agency over financial misappropriation.

    Reports earlier indicated that the EFCC was investigating Akinterinwa for allegedly mismanaging billions of Naira while serving as the Commissioner for Finance during late Rotimi Akeredolu’s administration.

    The report alleged that he was invited some weeks ago by EFCC to interact on some allegations but was “too busy” to honour the invitation.

    However, in a post on his verified X handle on Thursday, he said, “Today, I will be honouring the invitation from the EFCC to shed more light on some issues that the commission wants clarification on.

    “I have confidence in the anti-graft agency to conduct a thorough investigation and ensure that justice is done”.

    The fleeing farmers were unable to evacuate their belongings, including hundreds of goats, domestic animals, foodstuffs, and other valuables due to the shortage of vehicles. The presence of the military had previously provided a sense of security to Allawa and neighboring communities, making their sudden withdrawal surprising to residents.

    A woman identified as Ujunwa Okechukwu, her son and one other person were electrocuted at Mowe market in Obafemi-Owode Local Government Area of Ogun State.

    About four people were also injured in the incident that occurred on Monday, April 22, following an electric spark in the market after power was restored hours after rain fell.

    The spark broke out from the step-down transformer suspended on an electrical pole next to the shop where the incident happened.

    The Director of Information at the Obafemi Owode Local Government, Segun Soneye, confirmed the incident to DailyTrust on Wednesday, April 24.

    He explained that the woman “was burnt into ashes.”

    Soneye blamed the incident on the construction of shops made of iron under the powerline by the traders. He said the chairman of the council, Lanre Ogunsola, had visited the affected shop owners and commiserated with them over the incident.

    He added that the LG boss had already given shop owners a seven-day ultimatum to evacuate their make-shift shops built under the high-tension powerline to forestall the recurrence of the incident.

    The council boss visited the injured victims, who were receiving treatments at Mowe Health Post, and assured them of quality medical care with all the expenses to be paid by the government.
