During the court proceedings, a witness revealed that he had protested and submitted a petition to the Independent National Electoral Commission (INEC). The witness, who had previously served as the State Collation Agent for the People’s Democratic Party (PDP) in 2015, also admitted to appearing as a witness in the 2019 presidential election dispute between Atiku Abubakar and former President Muhammadu Buhari.

Full Court Proceedings at the Presidential Election Petition Tribunal against Tinubu’s Victory

The court proceedings began promptly at 9 am, with notable presence from the Labour Party and Peter Obi, who brought forth a substantial collection of evidence that caught everyone’s attention.

Peter Obi, along with Dr. Datti Ahmed, Julius Abure, and the DG of the campaign, represented the Labour Party in court. Awa Kalu SAN led the appearance of the Labour Party counsel.

During the proceedings, Forms EC8A from various states such as Benue, Rivers, Cross River, Niger, Osun, and Ekiti were presented as evidence. However, the respondents, including INEC, Tinubu & Shettima, and APC, opposed the presentation of all these forms, except for Niger State, where they mentioned that document sorting in Suleja was still ongoing.

The day’s proceedings concluded at 1 pm and were adjourned until tomorrow, June 2nd, 2023, at 9 am.

Overall, the court session was marked by the substantial evidence presented and the ongoing legal battle as both sides presented their arguments.

“The news report, which in the newspaper’s mind is exclusive, is rife with blatant FALSEHOODS and destabilising innuendos, revealing the publication’s possible willful ignorance of the Nigerian Foreign Exchange Market,” he said.

How MDAs Squandered N3.8trn Under Buhari

The Senate has revealed how federal government Ministries, Departments, and Agencies (MDAs) misappropriated the N3.8 trillion they received from Service Wide Votes (SWV) over four years.

Matthew Urhoghide, chairman of the Senate Committee on Public Accounts, stated that the committee’s investigation revealed that hundreds of billions of naira were disbursed to federal agencies for salary shortfalls, despite the fact that such funds were already included in the agencies’ annual budgets.

The Service Wide Vote is an extrabudgetary provision for MDAs to meet dire needs or special emergencies for which there are no or insufficient funds in the Appropriations Act.

Before any government agency could access these funds, the law that established the Service Wide Vote stipulated that a formal request must be submitted to and approved by the president of the Federal Republic of Nigeria.

When former President Muhammadu Buhari was in office, the Senate Public Accounts Committee investigated the disbursement of N5 trillion from the SWV to more than 200 government agencies between 2017 and 2021.

The committee, presided over by Senator Matthew Urhoghide, invited 207 government agencies to participate in the investigation, but only 119 responded.

During Wednesday’s plenary session, the panel presented its report to the Senate and its recommendations were adopted.

Urhoghide, in presenting the report, stated that his committee’s investigation revealed that numerous agencies collected funds from SWV without consulting the National Assembly committees that are required by law to oversee the agencies.

He stated that some MDAs did not submit formal requests for the funds sent to them by the Accountant-General’s Office of the Federation.

He stated that where the President’s approval was sought and obtained, some MDAs utilised the funds for unrelated expenditures.

Senator said that some MDAs collected funds for projects that had already been budgeted for in Appropriations Acts.

He stated, “Hundreds of billions of Naira were said to have been used to cover salary shortfalls, despite the fact that these agencies had already received appropriations for personnel compensation and were on the IPPIS platform.

“In some instances, agencies received large sums of money for which they did not apply or for which they are unaware of the source and purpose.

“The IPPIS intervention to make up for insufficiencies or shortfalls in Personnel Costs has been abused and has ballooned into astronomical sums of money requiring legislative oversight.

“The majority of MDAs involved in the period under review avoided the Committee’s invitation to appear and refused to make submissions, possibly due to a lack of satisfactory explanations regarding the use of the funds made available to them.”

After adopting the committee’s recommendations, the senate urged the Executive to use a supplemental budget approach to meet emergencies rather than a Service Wide Vote, which it deemed an affront/eroding of the National Assembly’s approval powers.

The committee also recommended that the Accountant General and other MDAs grant the Auditor-General for the Federation full access to audit Service Wide Vote expenditures annually and report to the National Assembly.

It also demanded an in-depth investigation into the operations of IPPIS in order to address the growing number of systemic irregularities.

Reject Atiku’s BVAS exhibits, Tinubu, INEC tell tribunal

On Wednesday, the Presidential Election Petitions Court in Abuja accepted 337 exhibits submitted by the Peoples Democratic Party and its presidential candidate, Atiku Abubakar, challenging President Bola Tinubu’s emergence as the winner of the February 25 presidential election.

At the resumption of the matter’s hearing, the PDP and Atiku’s legal team, led by Chief Chris Uche (SAN), informed the court that the documents in evidence pertained to 33 states of the federation, excluding Kaduna, Kano, Katsina, and Lagos.

Among the other documents Atiku submitted to the court were the results of the presidential election in the states of Abia, Bayelsa, Kaduna, and Ogun.

The petitioners informed the court that INEC downloaded the Forms EC8A containing the certified results from its I-Rev portal.

The petition’s respondents, however, objected to the admissibility of the Certified True Copies of the documents that were presented in court.

They stated that they would provide justifications for their objections in their concluding written addresses.

Tinubu, represented by a team of solicitors led by Chief Wole Olanikpekun (SAN), objected to the tendering of information that, according to the petitioners, was extracted from the Bimodal Voter Accreditation System machines used to conduct the 2023 presidential election.

In addition, the Independent National Electoral Commission stated that it was opposed to the admissibility of the documents, except for the data printouts from the BVAS systems it deployed in three states: Kogi, Sokoto, and Rivers.

In a similar manner, the APC opposed the admissible documents.

In addition, INEC’s legal team, led by Kemi Pinhero, SAN, argued against the admissibility of the downloaded results, just as other respondents did.

However, the five-judge PEPC panel led by Justice Haruna Tsammani admitted the BVAS documents and designated them as Exhibits PT 1 through PT 33.

The court accepted all 337 exhibits submitted by the PDP and Atiku.

Earlier in the day, the tribunal postponed until June 1 the hearing of the petition filed by the Labour Party and its candidate, Peter Obi, against Tinubu.

The adjournment was requested by the legal team of the LP, led by Chief Awa Kalu (SAN), who informed the court that two key team members were ill and unable to attend court.

Falana Sues FG Over No-Work-No-Pay Policy Against ASUU

Human rights lawyer Femi Falana (SAN) filed a lawsuit against the federal government yesterday for what he called discriminatory, unfair, and illegal treatment of members of the Academic Staff Union of Universities (ASUU).

The Minister of Labour and Employment, the Attorney-General of the Federation, and the Accountant-General of the Federation are named as defendants in the suit before a Federal High Court in Abuja.

Falana is asking the court to determine “Whether having paid the salaries of members of the Joint Staff Union, National Association of Resident Doctors (NARD), and lecturers in the medical facilities/medical and dental academic of the Nnamdi Azikiwe University, Nnewi Campus, Anambra State during the period of industrial action, the decision to withhold the salaries of ASUU members from February to October 2022 is not discriminatory and illegal.”

Falana also requests that the court determine “whether ASUU members are entitled to immediate payment of their salaries for the months of February to October 2022.”

According to Falana, the failure of the federal government to respond to ASUU’s demands has prolonged the labour dispute until October 2022.

CBN Devalues Naira To 630/$1

The Central Bank of Nigeria (CBN) has devalued the Naira to N631 per dollar, down from N461.6 at the Importers and Exporters (I&E) window the day before.

The devaluation occurred 48 hours after President Bola Ahmed Tinubu announced plans to unify the country’s exchange rate in order to stimulate the economy.

Minutes after being inaugurated as the 16th president of the country, Tinubu stated in his inaugural address, “Monetary policy requires a thorough spring cleaning. The Central Bank must strive for a standardized exchange rate. This will redirect funds from arbitrage into significant investments in the plants, equipment, and jobs that drive the real economy.”

According to experts, the wide gap between the I&E window and the parallel market encouraged round-tripping with Bureau de Change operators.

The situation has prompted the Central Bank of Nigeria (CBN) to devise a number of countermeasures and halt the sale of foreign currency to BDCs.

At the presidential villa on Tuesday, President Tinubu met with the heads of strategic institutions, including CBN Governor Godwin Emefiele.

Neither the presidency nor Emefiele disclosed the outcome of the briefing at the conclusion of the meeting. However, it was determined that the exchange rate was discussed at the meeting.

In addition, the President met with Mele Kyari, the Group Chief Executive Officer of the Nigerian National Petroleum Company Limited. It was gathered that the elimination of fuel subsidies was discussed.

At the resumption of weekly bidding for foreign exchange, the apex bank sold the spot rate to banks on behalf of their customers at N631 per dollar, and the majority of bidders received the full amount requested.

One of the customers informed our correspondent that their request was granted for N631 as opposed to N461.6.

The move has also led to a decline in parallel market prices. In Abuja and Kano, prices for a dollar fell from N750 in the early morning hours of yesterday to N745 by the evening.

On the parallel market, the naira fell to its lowest level in a year due to expectations of a possible change in exchange rate management following Tinubu’s inauguration on Monday.

On Friday, the naira fell from N775 to N762 per dollar on the black market in Lagos, according to Umar Salisu, a BDC operator who monitors the data in the nation’s commercial capital.

Since last week, the unit has steadily weakened on the parallel market after stabilising for the majority of this year.

In the past three years, the market arbitrage (difference between the official and parallel markets) has increased from N100 per dollar or approximately 30% in 2020 to over N400 per dollar (above 100%) sometime last year when the black market rate spiked to N880 per dollar.

Institutions specializing in international development, such as the International Monetary Fund (IMF), are wary of exchange rate differentials in excess of five percent and warn that such disparities could trigger unhealthy manipulations that could hinder other market stabilization efforts.

The CBN spent approximately $42 billion from 2020 to 2022 intervening in the foreign exchange market to stabilise the naira. The amount was sold to end-users, including students and tourists, at the official rates, which are significantly different from the naira’s actual exchange rate.

According to the Financial Stability Report, a publication of the Central Bank of Nigeria, the apex bank sold $9.2 billion in the first half of last year.

The complete data for the second half are unavailable, but the annualized value is assumed to have exceeded that, given the level of social and economic activity associated with the second half.

The black market rate averaged N730 per dollar, whereas the I&E window rate averaged N447 per dollar. This results in an arbitrage of N283/$, which increases the CBN’s FX subsidy for the year to approximately N3.65 trillion.

A police officer, Drambi Vandi, who allegedly shot and killed a Lagos-based attorney, Bolanle Raheem, on Christmas Day, concluded his defence on Wednesday at the Tafawa Balewa Square location of the Lagos High Court.

Vandi is on trial for allegedly shooting and killing a Lagos-based attorney, Mrs. Raheem, in the Ajah neighbourhood of Lagos on December 25, 2022.

At the resumed hearing, the defence attorney, Mr. Jude Ugwu, questioned the defendant.

Vandi testified in court that he had never seen the bullet identified as the alleged murder weapon.

He claimed that the bullet was not the same ammunition that had been in his rifle on the day of the incident.

Vandi described attending a local training academy where he learned about weapons and ammunition.

According to him, the police receive rifle training every five months to refresh their memories.

The defendant stated that he learned about the various types of rifles, pistols, and ammunition in training school.

The defence attorney, however, requested that the court produce exhibit P11(a), the bullet and six-round magazine, which is exhibit P19.

Therefore, the witness informed the court that a portion of P19 was a shell from a variety of rifles used in an AK-47, noting that the exhibit was a long-range bullet.

He explained that the bullet on display could travel more than 500 metres.

“If you line up ten people, this bullet will penetrate each and every one of them.

“When shot at close range, it cannot remain inside a person’s body, and it must penetrate through any nearby object.

“It must traverse at least four obstacles. This is not the ammo in my firearm on December 25, 2022.

“The firearm is autoloading. “In order to use this bullet, you must cork the rifle, and anyone nearby will hear the cork,” the defendant explained.

He stated that immediately after firing the rifle, the shell would fall to the ground near the person who fired it and remain there.

Vandi stated he had never seen the bullet before it was presented in court.

Additionally, the witness stated that the item was not the type of ammunition used by law enforcement.

The witness stated during cross-examination by the Director of Public Prosecution, Dr. Babajide Martins, that he was on duty at the Ajah underbridge on December 25, 2022.

The witness stated that he carried a rifle with 25 rounds of ammunition while on duty.

He explained that he had signed and reserved the firearm with the armament specialist.

He also informed the court that he was not the only armed officer on duty that day.

Vandi also described his arrest, detention, and statement writing following the incident.

“I wish the deceased was still alive and I lament her passing. “May her soul rest in peace,” he prayed in conclusion.

The defence attorney had previously informed the court that the defendant was the only witness for the defence.

However, he requested that the court grant them 21 days to file and adopt their written addresses.

Justice Ibironke Harrison ordered the parties to exchange written addresses following the presentation of evidence.

However, Harrison adjourned the case until July 13 in order to adopt final written addresses.
