    Anxiety as Supreme Court gives Judgement on cash swap

    Nigerians are nervous as they await the Supreme Court’s decision in the cases filed by some states to challenge the constitutionality of the Federal Government’s naira swap policy.

    After hearing final arguments on February 22, a nine-member panel of the Supreme Court, led by Justice John Okoro, scheduled judgement for March 3 for l final judgement

    Kaduna, Kogi, Zamfara, Katsina, Lagos, Cross River, Ogun, Ekiti, Ondo, Sokoto, Rivers, Kano, Niger, Jigawa, Nasarawa, Plateau, and Abia states are the plaintiffs in the cases.

    Following an application by Bayelsa and Edo states, the court joined the two states as co-defendants with the original sole defendant, the Attorney General of the Federation, on February 15. (AGF).

    In his final submission, Abdulhakeem Mustapha (SAN), the lawyer for Kaduna and Kogi states, urged the court to grant all of the reliefs sought in his clients’ suit and dismiss the notices of objection filed by the AGF and Bayelsa State.

    Abiodun Owonikoko (SAN), lawyer for Zamfara State, who adopted Mustapha’s arguments, said his client also filed an application on February 17 asking the court to set aside President Muhammadu Buhari’s directive on February 16 directing that only N200 notes be used, despite the court’s pending order.

    Owonikoko went on to say that the Federal Government’s naira redesign policy violated Section 17(2)(c) of the Constitution, which states that governmental actions must be humane.

    He also stated that the policy has caused hardship for the people.

    The Attorney General of Lagos State, Moyosore Onigbanjo (SAN), who represented the state, stated that his office filed several documents in the case.

    One of these documents, he said, is a motion seeking an order prohibiting the defendant/respondent (the AGF) from being granted audience before this court until the defendant or his principal, the President of Nigeria, complies with the order issued by this court on February 8th, directing that the old notes remain legal tender until the suit is resolved.

    Onigbanjo stated that the Lagos suit was distinct from those filed by other states in that it sought relief for the state of Lagos rather than the people of the state.

    He stated that the suit was motivated by the fact that the naira redesign was interfering with the government of Lagos State’s ability to perform its functions and meet its responsibilities.

    The Lagos Attorney General urged the court to deny the AGF audience and grant the prayers requested in the suit.

    Samuel Ologunorisa (SAN), who represented Katsina; Shuaibu Abuwa (SAN) for Cross River; Tunde Afe Babalola SAN, for Ogun); O. O. Olowolafe SAN for Ekiti; Charles Titiloye SAN for Ondo and Georgina Udeh for Sokoto State, all urged the court to dismiss the objection raise against the suit by the AGF and Bayelsa State and proceeded to grant all the reliefs sought in the suit by Kaduna, Kogi and Zamfara states.

    Rivers, Kano, Jigawa, Nasarawa, and Abia argued in separate cases that were consolidated with the case by Kaduna, Kogi, and Zamfara states that the policy was unconstitutional and should be repealed.

    The AGF, Bayelsa, and Edo states, represented by Kanu Agabi (SAN), Tijani Gazali (SAN), Kenneth Mozia (SAN), and Audu Anuga (SAN), urged the court to dismiss the suit for lack of jurisdiction and incompetence.

    Agabi, who also claimed that the necessary parties were not present in court, criticised the absence of the CBN governor as a party in the suit.

    He noted that the plaintiffs’ originating summons and supporting affidavit made 32 references to the CBN, while seven reliefs were sought against the apex bank, which was not made a party in the suit.

    Agabi, who stated that his client filed a motion on notice seeking the dismissal of the Form 48 issued on the AGF and the Governor of the Central Bank of Nigeria, also stated that an affidavit to show cause why Form 48 should be set aside was also filed.

    He contended that President Buhari’s February 16 broadcast did not violate the court’s order, insisting that it was a necessary intervention.

    In a statement issued on Thursday by the Director, Media & Publicity for the APC Presidential Campaign Council, Bayo Onanuga said Nigerians simply rejected Peter Obi who presented himself as an ethnic and religious bigot.

     

    The statement reads in part:

     

    “We watched with dismay today’s press conference addressed by the Presidential candidate of Labour Party, Mr. Peter Obi where he made very weird and wild claims about the outcome of the just concluded Presidential and National Assembly elections, an election in which he emerged a second runner up, according to the result declared by the Independent National Electoral Commission”.

     

    “We welcome the decision of Mr. Obi to seek redress in court as an aggrieved party if he is convinced of the evidences of electoral frauds he will present before the tribunal as alleged.

     

    “Going to court is part of the electoral process and it is the most decent, statesmanlike and civilised course of action to take. We salute the decision. It is surely better than calling supporters to the streets and instigating social unrest.

     

    “Before Mr. Obi goes to court, we consider it necessary to challenge some specific claims in his press address. Contrary to his statement, it is not true that the election held 25 February was not free and fair.

     

    “The 2023 election is one of the most transparent and peaceful elections in the history of Nigeria. It is because the process was credible that made it possible for Mr. Obi’s Labour Party to record the over six million votes it got contrary to pre-election forecast.

     

    “That Labour Party and Mr. Obi surprised bookmakers by winning in Lagos State, Nasarawa, Plateau, Delta and Edo where there are sitting governors of either the All Progressives Congress or the Peoples Democratic Party. Those governors have entrenched political machinery. That Obi won attests to the credibility of the election process. In those states, most of the sitting governors contested election to go to the Senate and lost to little known candidates of Labour Party.

     

    “The Labour Party also swept the entire five South East states under the control of either APGA, PDP or APC.

     

    “We believe that the Labour Party Presidential Candidate contradicted himself and exposed himself to public ridicule by suggesting that the election was only credible in states and places his party won.

     

    “We need us to forewarn Mr. Obi, that when he gets to court he should be prepared to tell the world how his party won over 90% of votes in his region of South East while other parties got almost nothing. We have evidence of voters suppression, intimidation and harassment in South East especially of those who came out to vote for our party.

     

    “Also when Mr. Obi gets to court, he will have to convince the court with his allegation of rigging in over 40,000 polling units across the country especially in North West and North East where his party had no party agents and did not sign result sheets as required by law. It is our assumption that Labour Party will enlist PDP agents to prove its fraud claims since it is an affiliate of PDP.

     

    “We want to state again for the umpteenth time that Mr. Obi didn’t win the presidential election and could not have won under any circumstances. This is because he had no path to winning a national election in a multi-ethnic and multi-religious society like Nigeria where a candidate running in a national election must appeal to the cross-section of our pluralistic society.

     

    “Mr. Obi anchored his presidential campaign on the failed strategy of ethnicity and religion, the divisive and dangerous politics that has hobbled the progress of our country for decades.

     

    “Nigerians simply rejected an ethnic and religious bigot through their ballots.

     

    “Mr. Obi all through his campaign presented himself as the candidate of the Christians and the Church, who wanted to help ‘take back their country” from the Nigerian Muslims.

     

    “His campaign also ran on the engine of ethnicity, inflaming strong Igbo sentiments. He also sought to cash in on the supposed youth discontent in Nigeria, as fuelled by the ENDSARS protest in 2020.

     

    “While Labour Party positioned its candidate as the harvester of the youth votes, its planners forgot that Nigeria does not have a homogeneous and monolithic youth population that can deliver bloc vote to any candidate.

     

    “All the major parties that contested the election also have strong youth appeal and supporters.

     

    “The lesson in Mr. Obi’s defeat in the election is that no politician in Nigeria can win a presidential race by being a sectional and an anointed candidate of any religion.

     

    “God created our country in a way to make it impossible for any part of the country to exist without the other. The framers of our constitution also worked to bind our country together with provisions that will make it impossible for a section of the country and any religion to have political domination over the other.

     

    “What this means is that any aspiring politician for the presidency of Nigeria must have a Pan Nigeria appeal and strong support and must be embraced by adherents of other religions.

     

    “Mr. Obi and his party knew why they failed. They knew they had no path to victory with their negative and dangerous campaign.

     

    “We owe Labour Party and Peter Obi the blunt truth: They failed in the election. No amount of red-herring and misinformation about the election and the outcome can obliterate this reality.

     

    “The President-Elect who was the candidate of our party won a Pan Nigeria mandate in a free, fair and credible election.

     

    “He is ready and prepared to assume office so he can serve the people of our country with sincerity and honour.

    Peter Obi, the Labour Party’s presidential candidate, has vowed to reclaim the mandate he claims Nigerians gave him on February 25, 2023.

     

    Obi ran against Bola Tinubu of the All Progressives Congress (APC), Atiku Abubakar of the Peoples Democratic Party (PDP), and Rabiu Kwankwaso of the New Nigeria Peoples (NNPP).

    In the early hours of Wednesday, the Independent National Electoral Commission, INEC, declared Tinubu the winner and President-elect.

    As of Thursday, March 2 at noon, results from more than 28,000 polling stations had not been uploaded to the INEC website.

    The former governor of Anambra State announced at a press conference in Abuja that he and his party would challenge Tinubu’s victory in court.

    Obi, on the other hand, urged his supporters across the nation to remain peaceful and allow the law to take its course.

    Dear Nigerians,

    On February 25, 2023, Nigerians turned out en masse to participate in presidential and National Assembly elections that were promised and expected to be free, fair, and transparent. But in all circumstances, we are obligated to express gratitude.

    To the Almighty God for granting Datti Baba-Ahmed and me the opportunity to champion the cause of a New Nigeria that will fundamentally improve our country’s fortunes. Please accept my appreciation and gratitude for all Nigerians who voted in our most recent election, especially those who believed in and tirelessly worked for a New Nigeria and voted for us. My deepest gratitude goes out to the youths, “Obidients,” and support groups for your dedication and perseverance towards a better Nigeria. You truly demonstrated that you can reclaim your nation!

    We continue to pray for the repose of the souls of all Nigerians who perished during the campaigns, as well as those who were violently attacked. We pray for a speedy recovery. We reaffirm our total condemnation of such attacks and continue to demand that security agencies halt future attacks and bring those responsible to justice.

    The dedication and tenacity of Nigerians, even in the face of unjustified and barbaric attacks, is evidence that a New Nigeria is in fact Possible. Jennifer Efidi, who was stabbed but insisted on exercising her right to vote, along with all Nigerians who voted in the election, are the shining stars guiding us to a New Nigeria.

    The election has been conducted and the results have been announced as scheduled. It is a clear departure from the electoral rules and guidelines as promised, and it did not meet the minimum requirements for a free, transparent, credible, and fair election devoid of voter intimidation and suppression, as well as the late start of voting in some states.

    This election will likely go down as one of the most controversial ever held in Nigeria. The good and hardworking people of Nigeria have been robbed again by our trusted institutions and leaders.

     

    However, I respectfully and humbly request that all Nigerians remain peaceful, law-abiding, and conduct themselves in a responsible manner. Please be assured that for Datti, myself, and all of us, this is not the end, but the beginning of the journey to birth a New Nigeria.

     

    Datti Baba-Ahmed and I remain absolutely unflinching and deeply committed to this project of a New Nigeria that will be founded on integrity, transparency, fairness, justice, and equity. All of these begin with the process – the process by which people are elected to office is just as important, if not more so, than what they do with the office and authority once they attain it.

     

    If we wish to be referred to as Your Excellency, then the process by which we are elected must be excellent or sufficiently credible to inspire the confidence and moral authority necessary to govern and lead. As you are all aware, the destruction of a society can be a gradual or sudden process involving acts such as deliberate disobedience to the rule of law and the suppression of the people’s will.

    Permit me to reaffirm and reassure the good people of Nigeria that we will use all legal and peaceful means to reclaim our mandate.

    Nigeria’s Election Drama Continues As PDP Rejects Declaration, Return of APC Presidential Candidate as President-Elect

     

     

    The National Working Committee (NWC) of the Peoples Democratic Party (PDP) on behalf of all members of the PDP, rejects in its entirety the declaration and return of the Presidential Candidate of the All Progressives Congress (APC), Senator Bola Ahmed Tinubu, as President-elect by the Independent National Electoral Commission (INEC).

    The PDP demands that INEC immediately withdraws the Certificate of Return issued to the Presidential Candidate of the APC and cancel the Presidential election declaration in line with its powers under Section 65 of the Electoral Act 2022.

    The Party insists that INEC in declaring the APC Presidential Candidate as winner, acted contrary to the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Electoral Act 2022 and the INEC Guidelines and Regulations for the conduct of the 2023 Presidential election.

    The PDP holds that its Presidential Candidate, Atiku Abubakar clearly won the February 25, 2023 Presidential election having evidently scored the majority of lawful votes cast by Nigerians at the Polling Units.

    Sadly, the election was marred by deliberate malpractices including the non-use of the Bimodal Voters Accreditation System (BVAS) and INEC’s refusal/failure to transmit directly the results from Polling Units to its Server/Website in flagrant violation of Section 60 (4)(b) of the Electoral Act 2022.

    This violation of the Electoral Act by INEC as attested to by political parties, voters, Nigerians of all walks of life as well as local and International Observers, paved the way for the alteration, falsification, switching of results and allocation of figures in favour of the APC.

    Nigerians can recall how on Friday, November 11, 2022, INEC through its National Commissioner and Chairman of INEC’ Information and Voter Education Committee, Festus Okoye, assured that results will be transmitted directly from the Polling Units to ensure the integrity and credibility of election results in Nigeria.

    In his words, “Our attention has been drawn to reports in a section of the media of alleged plans by the Commission to rig the 2023 General Election by abandoning the direct and real time electronic upload of Polling Unit results to INEC Result Viewing (IReV) Portal…

    “The Commission has repeatedly reassured Nigerians that it will transmit results directly from the Polling Units as we witnessed in Ekiti and Osun State Governorship elections…. The IReV is one of the innovations introduced by the Commission to ensure the integrity and credibility of election results in Nigeria. It is therefore inconceivable that the Commission will turn around and undermine its own innovations. The Bimodal Voter Accreditation System (BVAS) and IReV have come to stay for voter accreditation and uploading of polling unit results in real-time in Nigeria”.

    By refusing therefore to transmit directly the results from the Polling Units, INEC violated the Electoral Act and its Rules and Regulation, compromised the process and marred the integrity and credibility of the election results.

    The PDP therefore asserts that consequent upon the violation by INEC of Section 60 (4) of the Electoral Act, 2022 and its Rules and Guidelines on the election, the results announced by the INEC Chairman, Prof. Mahmood Yakubu, having not been earlier transmitted DIRECTLY from the Polling Units before the announcement are ultra vires, of no consequence and cannot stand.

    Consequently, our Party and its Presidential Candidate have commenced action for legal redress to reclaim our victory in the 2023 Presidential election.

    We appeal to our numerous supporters in Nigeria and across the world to remain calm, resilient, resolute and steadfast in the defence of democracy and the victory of our Party in the 2023 Presidential elections.

    Our verdict

    Therefore, the allegation that President Biden called for the cancellation of the most recent presidential election in 2023 is false.

     

    Some Nigerians, including former President Olusegun Obasanjo, demanded the annulment of the election while the results were still being tallied.

    Peoples Democratic Party (PDP) and Labour Party (LP) joined the call for cancellation after the Independent National Electoral Commission (INEC) failed to immediately upload polling unit results to the results-checking portal as promised.

     

    Professor Mahmood Yakubu, chairman of the Independent National Electoral Commission (INEC), continued the vote count and declared Bola Tinubu, the presidential candidate of the All Progressives Congress (APC), the winner after he received over 8 million votes.     Protest Rocks Abia State INEC Headquarters Over Election Result

     

    In opposition to the Presidential and National Assembly elections held last week, a group of protesters have stormed the Abia State headquarters of the Independent National Electoral Commission INEC.

     

    The youth group, under the auspices of the Coalition for Civil Civil Society, arrived at the INEC facility with placards, proclaiming that they are from various parts of Abia and wishing to register their displeasure with the alleged election fraud perpetrated by INEC officials.

    The Coalition of Civil Society, led by Mr. Irobinkansi Abraham, has accused INEC officials of failing to transmit the results of last Saturday’s elections electronically as promised by the electoral commission.

     

    The youths warned that the anomalies of February 25 must not occur on March 11 in Abia State or any other Abia State party.

     

    They questioned why election results were not uploaded as they were being cast, but warned INEC to redeem its reputation on March 11 by conducting itself credibly.

    Irobinkansi asserted that his group was not mobilized or supported by any politician or political party for the demonstration.

    Blessing Whitney, a 12-year-old Chrisland student who died during the school’s inter-house sports, died as a result of electrocution, according to Adeniran, her daughter’s mother.

     

    On Wednesday, she announced it in an Instagram live video.

     

    In the video, she said, “I want to thank everyone for their support. Your phone calls and messages have helped us get through this difficult time.

    “The autopsy results have been released, and Desola was electrocuted. My daughter died as a result of electrocution. For the past two weeks, I have been subjected to trauma. They distributed letters and publications.

     

    “People made fun of me and my family. My child died as a result of electrocution. I told the school that I didn’t want any problems. I only want answers. They arrived at my house and knelt.

    I begged, I pleaded, I said ‘Mrs Amao please, I don’t know how autopsy is being done but I have browsed it and the image is scary. Please, my daughter is already dead; do not subject her to that ordeal; they will butcher her. I beg you, in the name of God, and as a mother, to assist me in investigating and determining what occurred.’

     

    “She stated that she is unsure. They refused to conduct an investigation.

     

    “My daughter was slaughtered for an autopsy. She was opened up. They extracted kidney, liver, stomach contents, blood, brain, and bone marrow from her. Omodesola was slaughtered solely to protect Chrisland’s reputation.”

     

    Whitney’s father, Dr. Michael Adeniran, had previously claimed that his daughter died of electrocution prior to the autopsy.

     

    Meanwhile, in a statement, the school administration stated that the deceased collapsed in “public view and not under any hidden circumstances,” and that she was rushed to the nearest medical facility for first aid.

    The Governor of Rivers State, Nyesom Wike, is set to visit Oyo State on Friday, March 3rd, 2023, to commission some projects executed by the administration of Governor Seyi Makinde

     

     

    According to a statement made available to Ejes Gist News Nigeria on Thursday by the Oyo State Commissioner for Information, Culture, and Tourism, Dr. Wasiu Olatubosun, Wike is expected to commission and flag off three projects.

     

     

    Olatunbosun said the projects billed for commissioning are the Dr. Omololu Olunloyo Airport road, the Aviation Fuel Tank Depot, and the Dr. Omololu Olunloyo Park in Ibadan.

     

     

    The projects are part of the State Government’s quest to boost its economy and create accessible roads in the State, the Commissioner explained.

    IMF reveals problems with CBN’s anchor borrowers’ programme.

     

    The International Monetary Fund (IMF) has discovered that loan repayments under the Central Bank of Nigeria’s (CBN) Anchor Borrowers’ Programme (ABP) are low.

     

    According to an IMF study titled ‘Nigeria: Selected Problems’ received by Ripples Nigeria on Tuesday, farmers have only been able to repay 24% of ABP loans as of January 12, 2023.

    This means that the central bank is struggling to recoup 76% of the loan, which farmers can repay in kind. Around N1 trillion has been disbursed since President Muhammadu Buhari established the scheme in 2016.

Since then, over 1 trillion naira has been released from this programme through mid-2022, with the CBN providing a growing share of banking system agricultural financing,” the IMF noted.

     

    According to the monetary fund, one of the issues with loan recovery is that the incentive system for payback is poor, and disbursed loans do not target the correct recipient.

    “Latest data from the central bank (November 2020) show that the repayment rate for the Commercial Agricultural Credit (CAC) Scheme is about 66 percent, however since the loans began in 2009, this is not a particularly high outcome.”

    The governor of Ondo stated that the All Progressives Congress (APC) elders’ committee was established to reconcile Tinubu and his opponents.

     

    Akeredolu stated in a statement signed by his spokesman, Richard Olatunde, that the committee will meet with every aggrieved party and urge them to work together.

     

    The governor added that the presidential election accurately reflected the preferences of the electorate, stating that the process was legitimate.

     

    “The President-elect has established committees to meet with those who ran against him in the election so that we can begin the healing process,” he said. I am a member of one of the committees. We will meet with them and appeal to them so that we can collaborate.

    “This election was not manipulated. People who voted were counted, as far as I am concerned, and not millions of votes. It has never been like this, with each candidate winning 12 states.

    He added, “Ondo people are progressives, and we will always be on the side of progressivism at the very least. We were at the forefront of the demand for a southern president from the beginning, so we had to put everything we had into it and we received support, which is why we are able to succeed.”

     

    Remember that Tinubu received 8,794,726 votes to defeat Atiku Abubakar of the Peoples Democratic Party (PDP) with 6,984,520 votes and Peter Obi of the Labour Party (LP) with 6,101,533 votes.

    Chief Aribogha Johnny, a prominent chieftain of the Peoples Democratic Party in Delta State and the Koromotiemowei of Ogbe Ijoh Warri Kingdom, formally defected to the All Progressives Congress on Wednesday.

     

    Johnny and his supporters defected just hours after the Independent National Electoral Commission declared APC presidential candidate Asiwaju Bola Ahmed Tinubu the winner of the 2023 election.

     

    In a signed statement, the former PDP chieftain said his “decision came not only as a result of the outcome of the recently concluded presidential election, but as a result of the level of marginalisation and disregard he has faced in the Peoples Democratic Party for many years.”

     

     

    According to him, his political allegiance had been with the PDP until the party leadership began treating him as a “low class member,” despite his contributions to the party’s successes at the state level in recent years.

     

    As such, I have decided to move to a party where my efforts in the politics of the state and beyond will be recognised and appreciated,” he stated.

     

    The APC leadership in Delta, led by the Director General of the party’s governorship campaign council, Elder Godsday Orubebe, and Chief Bosin Ebikeme, the director of the party’s contact and mobilization campaign council, expressed joy in receiving Johnny and his supporters, noting that his decision was in the right direction.

     

    They stated that the Delta APC would regard him as a genuine member who would participate in party decision making.
