Appeal Court sacks Akwa Ibom PDP guber candidate

On Tuesday evening, the Court of Appeal, Abuja Division, removed a member of the House of Representatives, Hon. Micheal Enyong, as the Peoples Democratic Party’s (PDP) Guber candidate of Akwa Ibom State.

In his place, the Court reinstated Mr. Umo Eno, a former Land Commissioner whose nomination by the party was overturned by a Federal High Court in Abuja on 20 January 2023.

In a ruling rendered in response to an appeal filed by the PDP against the decision of the Federal High Court, Justice Hamma Akawu Barka vacated the trial court’s decision on the grounds that it was based on errors.

Justice Barka concurred with counsel for the PDP, Mr Paul Usoro (SAN) and Uwemedimo Nwoko (SAN), that the judgment of the Federal High Court was erroneous and that the court was misled by the plaintiff to reach an unjust conclusion.

The Appellate Court determined that the issue of statutory delegates voting in the primary election is a party matter and that the lower court should not have inquired into it.

Justice Barka concurred with Usoro that only a political party’s National Working Committee (NWC) has the authority to conduct primary elections for the nomination of candidates for the general election.

The appellate court also ruled that since the lower court lacked the authority to investigate PDP’s internal affairs, the judge had no discretion in the matter.

Justice Barka subsequently upheld the PDP’s appeal and voided all orders issued by the Federal High Court in Michael Enyong’s favor.

In addition, the Court of Appeal ordered the member of the House of Representatives representing the Uyo Federal Constituency to pay N1 million to the appellant as litigation costs.

Usoro, in response to the judgment, stated that the Judiciary has done justice to the unlawful orders issued against PDP by the Federal High Court.

BREAKING: Wike’s loyalist, Nnamani loses out as PDP withdraws from Enugu East Senatorial race

Wike’s loyalist, Nnamani loses out as PDP withdraws from Enugu East Senatorial race

The Peoples Democratic Party (PDP) has withdrawn from the upcoming elections in Enugu East Senatorial Zone. The withdrawal is official.

Having officially expelled Mr Chimaroke Nnamani from the party, the PDP said it has withdrawn from the senatorial race.

People’s Democratic Party on February 10th officially expelled Mr Chimaroke Nnamani, who is their candidate running for the seat. Nnamani had earlier on January 20th, been suspended by the party. According to the National Secretary of PDP, “the NWC of PDP has after a very extensive review and consideration of the affairs of our Party in the country, pursuant to the provisions of the PDP Constitution (as amended in 2017) approved the suspension of Senator Chimaroke Nnamani (Enugu State)… with effect from today, Friday, January 20, 2023, over allegations of anti-party activities”.

READ ALSO: BREAKING: PDP expels Chimaroke Nnamani, 6 others

Nnamani had been heavily involved with campaigns for Asiwaju Bola Ahmed Tinubu, who is the APC presidential candidate. He had even intensified his activities after he was suspended, and dared his party to do its worst.

Consequently, on February 10, PDP decided to completely expel him.

    Read their statement below;

The National Working Committee (NWC) of the Peoples Democratic Party (PDP) at its 566th meeting today, Friday, February 10, 2023, approved the expulsion…Senator Chimaroke Nnamani – (Enugu State)… for anti-Party activities and other grave offences in violation of the Constitution of the PDP (as amended in 2017).”

Having officially expelled him from the party, PDP has withdrawn from the senatorial race, as, according to Nigeria’s electoral law, one can only run for political office in Nigeria if he is sponsored by his party.

Despite having filed a case against PDP for suspending him, Nnamani has continued his support for Tinubu, refusing to back down on his anti-party activities.

At the moment, Nnamani has no backing from his party, which, through the expulsion withdrew from the Senate race. He is therefore out of the race.

So, for the first time since 1999, the PDP will not be fielding any candidate for the 2023 Senatorial Election.

Reacting to the situation, former National Auditor of the party Barr. Ray Nnaji confirmed that by his expulsion, PDP has no candidate for the Enugu East Senate position.

Hear him; it’s not a matter of Electoral Act; it’s a constitutional matter. The constitution says for one to contest for any electoral position, he must belong to a politcial party.

“There is no room for a private candidate. So, by virtue of that expulsion, Chimaroke is not qualified to contest election.

“He also has no business at the Senate as it stands. The party should move to declare his seat vacant because he has no party as a Senator.”

Nnamani, who is one of the loyalists to Governor Nyesom Wike of Rivers State, is yet to react to the withdrawal.

Earlier in February, the General Synod, the legislative body of the Church of England, passed a motion permitting the blessing of same-sex couples in civil partnerships.

In a statement released on Monday, the group, however, accused the Church of England of following a path of false doctrine and going against the historical biblical faith by allowing same-sex blessings, stating that the action ” breaks our hearts.”

The group claiming to represent 75% of Anglicans worldwide stated that the Archbishop “tragically led his House of Bishops to make the recommendations (for blessing gay couples) knowing that they are contrary to the faith and order of the orthodox provinces within the communion.”

“We pray that our withdrawal of support for him (Welby) to lead the entire Communion is understood as a loving rebuke.”

Court dismisses suit seeking sack of IGP Alkali Baba Usman

On Tuesday, a Federal High Court in Abuja dismissed a suit seeking Alkali Baba Usman’s removal as Inspector General of Police, IGP.

In his ruling, Justice Omotoso cited Section 7(6) of the Police Act of 2020, which stipulates a four-year term of office for the Inspector General of Police.

The judge ruled that Alkali Baba Usman’s retirement from the Nigeria Police Force has no bearing on his appointment on the grounds that the four-year term is sacred.

In addition, Justice Omotoso ruled that the plaintiff, who claimed to be a social crusader, lacked the authority to file the lawsuit in the name of public interest.

He ruled that the plaintiff failed to establish a special or unique interest in comparison to other Nigerians.

In particular, Justice Omotoso described the plaintiff as a busybody and meddlesome interloper, adding that he was not a serving police officer qualified for appointment or had ever applied for IGP’s position and denying that he has no legal standing to file the lawsuit.

Idoko, through his Counsel, Chief James Ogwu Onoja, a Senior Advocate of Nigeria SAN, filed a lawsuit challenging the legality of the IGP’s continued tenure in office after his term had expired.

Prof. Pat Utomi, the Convener, The Big Tent of the Third Force, says the coalition and the Labour Party (LP) plan to deploy at least 15 agents each to polling booths in the country to help safeguard votes in the 2023 general elections.

Utomi, the Chairman of, the National Consultative Front (NCFront) and a leader in the Labour Party, disclosed this in a statement on Friday in Lagos on Election Agenda.

According to him, the coalition has worked and made many sacrifices to get Nigeria to move from state capture by ageing oligarchs and to make the nation overcome its numerous security and economic challenges.

“The broad coalition of women, youth, professionals and the intellectuals which have adopted the leadership of the Labour Party and Peter Obi is serving notice that in addition to its agents which will number up to 15 in each polling booth in the country, it will use technology to guard the votes of Nigerians in 2023.

He said the organization would in the next week, unveil the details of Mass Polling Booth education programmes and the retreat for the gubernatorial candidates and ideology workshops for all Third Force candidates.

The convener, who expressed delight that Nigerians’ political awareness had continued to rise, said “People have awoken. They want to take back their country”.

He said that the coalition and LP were planning to counter all electoral manipulations and violence in 2023 that could throw up bad leaders.

“The last frontier before liberation for the people is in checkmating the traditional ways and means by which they thwart the will of the people.

“These include Election fraud or rigging, vote-buying, manipulating of electronic voting, equipment and voter intimidation, as well as abuse of emotions around ethnicity, religion and region,” Utomi added.

According to him, the coalition will inaugurate Big Tent Think Tank to harmonise the original manifesto of the Labour Movement with the production-focused philosophy of its Presidential Candidate, Peter Obi.

He said this would include the production and value chain-based ideas of a competitive economy, based on the latent comparative advantage of the different parts of Nigeria aimed at sustainable manufacturing espoused for years.

Utomi said contrary to claims about the governance capacity, structure, and manifesto of the Big Tent of the Third Force (which has the Labour Party and its Presidential Candidate, Obi as the arrowhead of a collegial leadership initiative), the coalition was ready to provide the needed leadership.

According to him, leadership has networks reaching down to every polling booth through the 36 political commissions of both the Nigeria Labour Congress and the Trade Union Congress.

Utomi said the structure of the Big Tent had been deepened by the passion with which the people, young and old were motivated to buy into the reform pointed to by Mr Peter Obi.

EXPOSED: Simon Ekpa Accused of Receiving $1Million To Destroy Peter Obi’s Chances

Simon Ekpa has been accused of receiving $1million to destroy Peter Obi’s chances of winning the presidential election.

The apex socio-cultural organisation in Igboland, the Ohanaeze Ndigbo Worldwide, has urged Simon Ekpa to return the alleged $1million he collected from his paymasters, to tarnish the chances of the presidential candidate of the Labour Party, Peter Obi, in the 2023 presidential election.

According to the group, Ekpa would be hunted across the world to pay for the atrocities he has committed against the South-East geopolitical zone.

It further observed that the leader of the splitter group of the Indigenous People of Biafra, was acting the script of those who were opposed to a Nigerian president of Igbo extraction.

The Secretary-General of Ohanaeze Ndigbo Worldwide, Comrade Okechukwu Isiguzoro, said this during an interview with our correspondent, on Tuesday.

He said, “Ohanaeze Ndigbo Worldwide has cautioned one Simon Ifeanyi Njoku Ekpa to return the funds he collected with the evil intent to destroy the prospects of the Labour Party to win the 2023 presidential election on February 25, 2023.

“Intelligence reports have it that Simon Ekpa became frightened that his secrets have been uncovered and he quickly retreated and withdrew his response to the $50,000 bounty placed on him and has been begging Ohanaeze Ndigbo in the last 24 hours through the third-parties to reconsider and review the sanctions as well as drop the bounty placed on him.

“Ndigbo’s response to Simon Ekpa’s plea is that he should return the $1m to the disfavoured and unpopular presidential candidate he’s working with. He must quickly return all he had collected (to his paymasters) in other to destroy the support base of Peter Obi through his old-fashioned mantra of, ‘No Election in Biafra Land’, and rescind his intentions to declare a four-day sit-at-home from 22nd to 26th of February 2023 with a view to disrupt the 2023 presidential elections in the South-East.

“Ndigbo will resist every attempt by Simon Ekpa to scare away voters in the South-East and South-South through his planned four-day sit-at-home. Our suspicion was reinforced after Ekpa asked for forgiveness and we knew that his plans to boycott the elections in southeastern Nigeria were to stop ‘ObiDient’ devotees from voting for Peter Obi and lessen the strength of the South-East.

“The 2023 presidential elections must hold in the South-East, and Ndigbo must vote for whoever is their choice at the polls. Simon Ekpa must pay back all that he has amassed from the enemies of Ndigbo, stop his killer squad in southeastern Nigeria, show remorseful repentance and apologise for the inconveniences caused by his rantings and crooked falsehoods about Ndigbo.

“Except he abides by this conditions, Ndigbo will smoke him out of his hideouts at Finland and Europe, as Ndigbo and Nigerians in Finland and Europe have responded positively on the $50,000 bounty placed on him.

“It’s a matter of time, Simon Ifeanyi Njoku Ekpa will be apprehended, and his extradition to Nigeria will happen shortly so that he can answer all the crimes and killings he instigated in the South-East.

  • Two APC ministers, Fashola and Keyamo disagree over naira redesign policy

Two APC ministers, Fashola and Keyamo disagree over naira redesign policy

Two APC ministers, Babatunde Fashola and Festus Keyamo have disagreed over naira redesign policy

The Minister of Works and Housing, Babatunde Fashola (SAN), has said the directive of President Muhammadu Buhari that the old N200 notes be recirculated until April 10, 2023, while the old N500 and N1,000 cease to be legal tender, was not a direct affront to Supreme Court.

Fashola, who is a Senior Advocate of Nigeria (SAN), contrary to a recent comment by the Minister of State, Labour, and Employment, Mr. Festus Keyamo (SAN) in which he had faulted President Muhammadu Buhari’s directive on old currencies.

Fashola at the weekend argued that the directive of the president was not a direct affront to Supreme Court that had temporarily halted the move to ban the old currencies by February 10, 2023.

Speaking to our correspondent , the former Lagos State governor maintained that the president only took the step to help ameliorate the pains of Nigerians who were becoming the unintended victims of the policy.

Keyamo, who is also a Senior Advocate of Nigeria (SAN) and spokesperson for the All Progressives Congress Presidential Campaign Council, had in an interview, said the president was wrongly advised to make the pronouncement in a nationwide broadcast.

READ ALSO: BREAKING: APC Spokesperson, Keyamo moves for Atiku’s arrest, trial over alleged corruption

According to Keyamo, although Buhari had good intentions for the naira redesign policy, he was wrongly advised. He had also said he would have advised the president to comply with the Supreme Court order, which was to recirculate all the old notes until they decide on the matter.

“My view is that the president acted honestly, without intention to slight the Supreme Court, but he may have acted on wrong advice. I did not give that advice, it’s not my responsibility. I do not know who gave that advice.

“In his speech, he acknowledged that there were certain matters in court. So, he thought he was playing safe by saying okay before you decide these matters in court, may I just provide some middle ground, so that the country is burning, there are riots everywhere, so let me just try and provide some succour for people, whilst acknowledging the matters are in court.

Now, if I were to advise him, I would have advised differently. I would have advised him to comply with the terms of the order of the Supreme Court. All the notes should circulate, for now, all the notes. All the old notes should circulate side by side with the new notes for now, because that is the order of the Supreme Court,” he had said.

According to him, the matter was not discussed at the Federal Executive Council.

The comments by Fashola came just as a viral video of some residents of Ogun State being bribed ahead of Saturday’s election with the old N1,000 notes. Those who received the money in white envelopes with the logo of the state government, however, expressed concerns that commercial banks were no longer accepting the currency. But someone suspected to be a government official, who spoke in Yoruba, was heard assuring the beneficiaries that they should go ahead and spend the money, adding that the government had vowed to ensure that banks in the state collect the old banknotes.

Fashola claimed that the recent nationwide broadcast by Buhari on the ongoing naira redesign policy was not a direct affront to the Supreme Court.

He stated that although the naira swap policy needed to be reviewed, the president took the decision because he had seen the suffering many Nigerians were facing and not to spite the apex court.

Fashola explained, “Let me say that in a democracy where there is a right to speak freely, there’s bound to be a divergence of views, as you have had. But I think that the principle about respecting and awaiting the outcome of a court decision sometimes has been stretched, if I may use that word.

“There is also a lot of jurisprudence and scholarship about the boundaries of contempt in actions done and in things said. If I shut the door on your finger, and you went to court to say that the court should direct me to remove or open the door, do I say let’s wait for the outcome of the court decision when you are in pain, and people are in pain?

“The question to ask is if I attempt to open that door, would you, the person in pain, say I was acting in contempt or would you gladly have me open the door and then go back to the court and say the matter we have resolved it?

“And that is another angle to look at this thing because I think that whatever interventions the president sought to make were interventions in response to the very palpable pain and I think he said that much in his speech about the unintended consequences of the policy.

Noting that his argument should not be misunderstood for misbehaviour while a case was pending in court, Fashola stated that the conversation around the matter had helped enrich Nigeria’s democracy. He explained that it had also shown the APC presidential candidate, Tinubu, and others that had spoken up as people of courage who would not sit in their comfort zones when the people were suffering.

Fashola said the fact that recent Central Bank governors in Nigeria tended to get into trouble close to elections should spur a review of the system to look at how political the apex bank had become. He stressed that although the Central Bank had a right to implement the current naira redesign policy, some of the reasons adduced by the bank were outside the law.

So the question to then ask is, has a law been used for a policy seeking to achieve an objective that is not within the law? And this is an invitation to parliament and I think this is the time to step up and say, have our politics left our central banking-related laws behind?”

The minister argued that what happened was a mop-up of Nigeria’s currency and not a swap, arguing that the central bank may not have expected the outcome.

“It seems to me that the central bank does not intend or contemplate a mop-up policy, it actually contemplates in my view, a swap of notes,” he added, pointing out that the central bank may have overreached itself.

Fashola said Nigeria changed notes some 15 years ago, stressing that it did not cause this much pain, but wondered why the present case was causing untold hardship. He stated that the current development might negatively affect the banking system in Nigeria. He said everyone must work together to ensure that the effect on the banks was mitigated.

DSS Steps Up Investigation Of Emefiele

The Department of State Services (DSS) has intensified its investigations in an effort to arrest and prosecute the governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, on charges of terrorism financing and fraud.

The defence headquarters has denied the allegation that the military is providing soldiers to protect the CBN governor at his home and office in an effort to thwart his arrest.

Following a failed attempt to apprehend the head of the central bank, Ejes Gist News Nigeria has learned that the secret police has reopened investigations into multiple allegations in an effort to apprehend the embattled Emefiele for possible prosecution.

An Online newspaper recently published some of the exclusive details it obtained from court documents regarding the controversy surrounding Emefiele’s trial, including funding for “unknown gunmen” and the outlawed Indigenous People of Biafra (IPOB).

DSS Steps Up Investigation Of Emefiele

The federal government had outlawed IPOB, a separatist organization that promotes the establishment of the Biafra republic and advocates for secession.

In the past few years, its members had murdered hundreds of civilians and security personnel, in addition to torching police and military formations, INEC offices, and other symbols of authority.

In the online publication’s report, Emefiele was also accused of undermining Nigeria’s national security by sabotaging the administration of President Muhammadu Buhari, financing terrorism, aiding and abetting terrorism, and committing other economic crimes.

It also accused the CBN governor of mismanaging the subsidiary of the central bank, NIRSAL, and the Anchor Borrowers Programme.

The DSS alleged that Emefiele financed IPOB/ESN with both the funds he raised for his unsuccessful presidential campaign last year and funds stolen from government coffers.

Additionally, the secret government agency accused Emefiele of “fraud, money laundering, round-tripping, and financial benefit to self and others.”

The report stated that he mismanaged government interventionist funds under his control and concluded that “investigation is still ongoing on a broader scale as other members of the syndicate chain must be identified and arrested to enable successful prosecution.”

DSS Steps Up Investigation Of Emefiele

Last year, Emefiele ran for the presidential nomination on the platform of the All Progressives Congress (APC).

Ejes Gist News Nigeria’s attempts to obtain his response to the allegations made against him by the DSS were unsuccessful because his office did not respond to inquiries.

However, at the height of the controversy surrounding his political ambitions, the CBN governor stated that his admirers funded the presidential form and other logistics, denying any wrongdoing.

He also petitioned the Federal High Court in Abuja for an order affirming his eligibility to vie for the APC’s nomination. However, on 9 May the court denied Emefiele’s petition.

According to multiple sources, the DSS continues to investigate all of the suspicions surrounding the CBN governor in an effort to bring him to justice.

Godwin Emefiele, has been governor since 2014 and he is the first person in nearly two decades to serve two terms as the head of Nigeria’s central bank. In June 2014, he was appointed by then-President Goodluck Jonathan, after Sarah Alade completed the term of the suspended Lamido Sanusi.

The Governor of Benue State, Samuel Ortom, says he is ready to sacrifice his senatorial ambition in the National Assembly elections this Saturday, if it will ensure the victory of the presidential candidate of Labour Party, Peter Obi.

Ortom, a member of the Peoples Democratic Party (PDP), is contesting the election in the Benue North-West senatorial district.

His January endorsement of Obi came after months of refusal to support the PDP presidential candidate, Atiku Abubakar, whose emergence in May 2022 was viewed by several high-ranking party members as unfair.

The Benue governor reiterated his support for the former Anambra State governor while addressing members of the Igbo community in the state on Monday.

“For me, it’s not even that I’m contesting an election. Yes, the form was bought for me by the people of Benue State. I’ve gone round; they have accepted that they will vote [for] me,” he said.

Ortom identified with those who believed in the unity of Nigeria and working together, saying it was for this reason that he accommodates everybody.

“So, let us not miss this opportunity that God himself is providing. The youth have told me, my own people have told me – stakeholders here, traditional rulers, party people across party lines. Obi’s matter is not about APC or PDP or SDP or any other party. It’s about Nigeria.”
