NBA Speaks on Samoa Agreement
The President of the Nigerian Bar Association (NBA), Mr. Yakubu Maikyau (SAN) has clarified the position of the Association on the recently signed Samoa Agreement. He said it does not make Nigeria to recognize Lesbian, Gay, Bisexual, Transgender and Queer (LGBTQ) rights.
In a statement released by NBA National Publicity Secretary, Mr. Habeeb Lawal, Maikyau warned against the spreading of misinformation on the agreement. He said we should get the facts right and share the facts.

My attention was drawn to publications in the newspapers and social media and reactions by some Nigerians on the signing of the Samoa agreement by the federal government. Either due to ignorance of the content of the agreement or deliberate attempt to mislead the public, I want to state: There is no provision in the Samoa agreement that makes Nigeria to accept or recognize LGBTQ or gay rights, either as a condition for a loan of $150 billion or at all.
He further clarified that the agreement respects the local laws and sovereignty of the contracting parties. “The agreement was made subject to the local laws and the sovereignty of the contracting parties. That is to say, the Samoa agreement recognizes for instance Nigeria’s Same Sex Marriage (Prohibition) Act 2023 and of course the Constitution of the Federal Republic of Nigeria,” Maikyau said.

Maikyau said the NBA would have advised the Federal Government against any partnership that would undermine Nigeria’s sovereignty if such condition were in the agreement. “For the avoidance of doubt, the Samoa agreement does not in any way compromise our existing laws nor undermine Nigeria’s sovereignty. The negative narratives on this agreement are being pushed and propagated along very sensitive lines of our faith, culture and morality, so we need to be cautious and educate ourselves,” he concluded.
This statement aims to quell the rising concerns and clarify the NBA’s stance, ensuring the public understands the true implications of the Samoa Agreement.
