This is comes as Justice O.O. Oguntoyinbo of the Federal High Court, sitting in the state capital of Abeokuta, ordered the PDP to hold new primaries within a 14-day period on Tuesday.

The court judgement invalidates the party’s primaries for the governorship, Senate, House of Representatives, and House of Assembly.

Additionally, the judgement forbade Ladi Adebutu from misrepresenting himself as the PDP candidate for governor of Ogun State and directed the Independent National Electoral Commission (INEC) not to accept his nomination.

The judge’s ruling was made while delivering the verdict in a lawsuit filed by three party members, Taiwo Olabode Idris, Kehinde Akala, and Alhaji Ayinde Monsuri, challenging the results of the party primaries.

The list of delegates utilized to hold the party’s primary election on May 25 had been deemed unreliable by the party chieftains.

In order to select the candidate that the first defendant (PDP) intends to nominate or sponsor at the 2023 Governorship election in Ogun State based on the list of delegates who were not democratically elected at the ward congress, the plaintiffs prayed to the court to nullify or set aside the state congress/indirect primary election held by the first defendant on May 25, 2022.

The 2nd Defendant (INEC) was also ordered to “disregard and/or refrain from giving effect to the results of the alleged 1st Defendant’s indirect primary election held on the 25th of May, 2022 based on the list of ad-hoc delegates who were not elected at the ward congresses constituted by the 1st Defendant for that purpose.”

Thaddeus Idenyi, the plaintiffs’ attorney, said that by declaring the election invalid, the court acted properly. He encouraged the PDP to follow the court’s directive and act morally this time.

“The implication of the ruling is clear; the PDP will need to band together and have a new primary as the court has instructed.

This time, the court made it clear that they must use the lists that INEC has certified. “After the primary, those lists were submitted to INEC as parts of its report of covering those ward congresses held, so the court has now said that is the list which must be considered in the conduct of the fresh primaries, so the PDP had to just put their house in order and use those lists to conduct a fresh primary,” he said.
