Supreme Court Dismiss Appeals Filed by Fmr. National Chairman of APC and Igo Aguma.
The Supreme Court has dismissed the appeal filed by Adams Oshiomhole, the former National Chairman of the All Progressives Congress, APC, and Igo Aguma, the former Chairman of the party’s Caretaker Committee in Rivers State, against his dismissal by the appeal court.
The court upheld Justice Amina Augie’s December 29, 2020 judgement of the Court of Appeal, Abuja, which overturned an earlier judgement of the High Court of Rivers State that the court lacked jurisdiction to hear the case because it was an internal party matter.

The Supreme Court ruled that the judgement in Aguma’s appeal should be applied to Oshiomhole’s, in which the former APC National Chairman, among others, questioned the Appeal Court in Abuja’s jurisdiction to hear the case.
On December 29, 2020, the Court of Appeal in Abuja overturned Justice George Omereji’s June 2020 judgement of the High Court of Rivers State in Port Harcourt, and sacked Aguma as Acting/Caretaker Committee Chairman of the APC in Rivers.
The Appeal Court also upheld Abbot Ogbobula’s appointment as Chairman of the Rivers State APC Caretaker Committee, stating that the National Working Committee of the All Progressives Congress has the sole authority to appoint a Caretaker Committee for any of the party’s organs under the party’s Constitution.
Igo Aguma was in the Supreme Court to appeal a Court of Appeal decision that overturned a High Court decision declaring him the Acting Chairman of the All Progressives Congress in Rivers State.
The Supreme Court upheld the appeal filed by the APC against Dele Moses and others on Friday. The court faulted the Court of Appeal for relying on the Supreme Court’s earlier decision in the APC and Umar case to hold that the trial court was correct in holding that the case was a pre-election matter.
Both cases were distinguishable, according to Justice Augie, because while the APC and Umar case concerned the conduct of the election, the suit filed by Dele Moses and ten others was a challenge to the APC’s guidelines for the conduct of the ward congresses.
Justice Augie also advised party members to always learn to follow party doctrines after adhering to the party’s rules and constitution.

In response to the rulings, Livingston Wechin, a party stalwart, said in a press statement that he has resigned from the APC with immediate effect because he “cannot continue to be a member of a political party that runs counter to democratic principles and does not provide any form of protection to its members’ rights.”
