Senator Kalu, who was Governor of the State of Abia between 1999 and 2007, was previously sentenced by the Lagos High Court Division to a 12-year prison term after he was found guilty.

He was convicted of allegedly diverting the sum of N7.1 billion from the state treasury to personal use alongside his company, Slok Nigeria Limited, and a former Director of Finance in Abia State, Jones Udeogu.

In a unanimous judgment delivered in 2020 by a seven-man panel of the apex court, the Supreme Court annulled the entire proceedings that led to the conviction of Kalu, noting that the trial judge, Justice Mohammed Idris, was already elevated to the court of appeal, as at the time he delivered the trial judgment.
