Why Court sacked governor Oyetola as APC Osun gubernatorial candidate

On Friday, a federal high court in Abuja overturned the nomination of Gboyega Oyetola, the governor of Osun state, as the All Progressives Congress (APC) candidate in the state’s governorship election.

Following a suit filed by the Peoples Democratic Party, the court invalidated the governor’s candidacy as well as that of his deputy, Benedict Alabi (PDP).

Justice Emeka Nwite ruled that Governor Mai Mala Buni of Yobe state violated Section 183 of the 1999 Constitution and Section 82(3) of the Electoral Act, 2022 by submitting their names to the Independent National Electoral Commission (INEC).

On Governor Oyetola’s Nomination, the court ruled…

While the PDP is the plaintiff in the FHC/ABJ/CS/468/2022 suit, Gov Buni, Oyetola, and three others are the defendants.


The PDP’s lawyer, Kehinde Ogunwumiju, argued that Mr. Buni violated the law by acting in a dual capacity by holding two executive positions, and he urged the court to void the nominations of Oyetola and his deputy.

In response, Oyetola’s lawyer contended that the PDP lacked legal standing to sue his client because it was not an APC member and only the APC was responsible for the nomination processes of its members.


As a result, he asked the court to dismiss the case because it lacked merit.

The PDP’s lawyer claimed that his client filed the suit in accordance with Section 285(14) (c) of the Federal Republic of Nigeria 1999 Constitution (as amended).

The presiding judge agreed with the plaintiff’s arguments and declared the governor’s and his deputy’s nominations null and void.

Mr. Buni violated Section 183 of the Constitution by holding dual executive positions as Governor of Yobe and Chairman of the APC National Caretaker Committee, according to Justice Nwite.

According to the judge, Buni’s decision, which included forwarding the names of Oyetola and Alabi to INEC, was illegal.
