High Court has Suspended APC from conducting Congresses in Bayelsa, Imo State.
The news now is that a high court sitting in Bayelsa has stopped All Progressives Congress, APC from conducting Congresses.
The order, restrained the Defendant ( APC) from allowing the Caretaker/Extra-Ordinary Convention Planning Committee or any of its appointees, assigns, underlings agents and privies within the Defendant from howsoever conducting Congress to elect State, Local Government Area and Ward Party leaders in Bayelsa State, scheduled to hold on the 31″ day of July 2021 pending the determination of the Motion on Notice already before this Court.
The case was adjourned to 9th August 2021 for a Hearing of the Motion on Notice.
In another development, the Federal High Court in Abuja has banned APC from holding congresses in Imo state.
Justice Valentine Oriji in his ruling on the suit filed by Okey Anyikwa who is APC chairman in Ideato South Local Government Area threatened to invalidate the outcome of congresses if the party disregards the position of the Court.
Anyikwa had approached the court to stop the APC in the state from going ahead with Saturday’s congresses because of the judgement of the Appeal Court that upheld the tenure of the State Exco elected in 2018.
All action regarding APC congresses in the state is to be placed on hold, pending the hearing of the application slated for August 10.
AN ORDER OF INTERIM INJUNCTION, restraining the Defendant from allowing the Caretaker/Extra-Ordinary Convention Planning Committee or any of its appointees, assigns, underlings agents and privies within the Defendant from howsoever conducting Congress to elect State, Local Government Area and Ward Party leaders in Bayelsa State, scheduled to hold on the 31″ day of July 2021 pending the determination of the Motion on Notice already before this Court.
AND for such further order or orders as this honourable court may deem fit to make in the circumstance.
Upon this Motion, Exparte dated and filed on the 29/07/2021 coming up on the 30/07/2021 before Hon. Justice-LA. Uzakah sitting at High Court 8, Onopa, Yenagoa.
AND after hearing the submissions of P.Y Fawei Esq. of Counsel for the Claimants/Applicants in this matter.
THE COURT HEREBY MAKE THE FOLLOWING ORDER.
Leave is hereby granted to the Claimants/Applicants to serve the Originating Summons and other accompanying processes and the Motion on Notice for Interlocutory Injunction on the Defendant/Respondent by substituted means to wit; through its Bayelsa State branch Legal Adviser at Mbiama/Yenagoa Road by Baybridge Junction, Yenagoa, Bayelsa State.
Adjourned to 9th August 2021 for Hearing of the Motion on Notice.
